論秘密偵查中的隱私權(quán)保護

【摘要】：秘密偵查措施在我國刑事偵查中的普遍使用是一個不爭的事實。秘密偵查具有常規(guī)偵查措施所不及的特殊功用,打擊犯罪的實效更顯著。但是秘密偵查措施的使用往往會牽扯到秘密偵查對象的合法權(quán)益,尤其是隱私權(quán)。秘密偵查權(quán)力與隱私權(quán)利的碰撞或沖突可以說是善與善的沖突,為實現(xiàn)各自的價值,二者需要法律的承認和保護；為盡量避免相互的侵擾或制約勢必需要立法尤其是公法予以協(xié)調(diào)和平衡。即立法需要給予秘密偵查權(quán)正當(dāng)介入隱私權(quán)的條件和途徑。而立法需要以保護公民權(quán)利為基點。 本文共有五章,第一章主要考察我國理論界對秘密偵查的研究現(xiàn)狀,通過收集、歸納、整理資料,探究秘密偵查理論研究取得的成果以及存在的些許爭議,對存在爭議的部分如秘密偵查的概念、分類、秘密偵查與技術(shù)偵查的關(guān)系上明確了作者本人的觀點,并以此為基礎(chǔ)展開下文的研究。第二章闡述秘密偵查與隱私權(quán)的相關(guān)理論,主要介紹了隱私權(quán)的內(nèi)涵和外延并對秘密偵查對隱私權(quán)的侵犯進行理論分析,筆者認為秘密偵查措施侵犯的公民隱私權(quán)的內(nèi)容和程度是有差異的。同時筆者分析了秘密偵查存在進入公民隱私權(quán)領(lǐng)域的正當(dāng)理由,總結(jié)了秘密偵查侵犯公民隱私權(quán)的具體表現(xiàn)形式。第三章是對秘密偵查中隱私權(quán)保護的國外考察。主要參考美德兩國對主要秘密偵查措施的立法、司法文件中是如何規(guī)范秘密偵查行為、保護公民隱私權(quán)的。本章的目的是通過考察,借鑒國外法律文本中秘密偵查法律制度的標準,以有益于構(gòu)建符合我國國情的本土的秘密偵查制度。第四章是對我國秘密偵查法律規(guī)范文件中隱私權(quán)保護的現(xiàn)狀、問題及原因的分析,只有立足本國實際、整體把握秘密偵查現(xiàn)狀、分析存在的問題和原因,才能提出切合我國國情的秘密偵查立法建議。第五章提出完善我國秘密偵查過程中隱私權(quán)保護的立法建議。立足我國當(dāng)前秘密偵查立法和實踐現(xiàn)狀,參考和借鑒國際標準,筆者從秘密偵查的立法原則即區(qū)別立法、秘密偵查立法中應(yīng)遵守的原則、秘密偵查對象的權(quán)利及救濟制度、違法偵查的制裁機制四方面構(gòu)建我國秘密偵查中隱私權(quán)保護的法律框架。
[Abstract]:It is an indisputable fact that secret investigation measures are widely used in criminal investigation in our country. The secret investigation has the special function which the conventional investigation measure does not have, and the actual effect of cracking down the crime is more remarkable. However, the use of secret investigative measures often involves the legitimate rights and interests of the object of secret investigation, especially the right to privacy. The collision or conflict between the power of secret investigation and the right of privacy can be said to be the conflict between good and good. In order to realize their respective values, they need the recognition and protection of law. In order to avoid mutual interference or restriction, legislation, especially public law, must be coordinated and balanced. That is, legislation needs to give secret investigation right to properly intervene in the privacy conditions and ways. Legislation should be based on the protection of civil rights. There are five chapters in this paper. The first chapter mainly studies the current situation of the research on secret investigation in the theoretical circle of our country, through collecting, summarizing, arranging the data, exploring the achievements and some disputes existing in the theoretical research of secret investigation. For the controversial parts such as the concept of secret investigation, classification, secret investigation and technical investigation of the relationship between the author's point of view, and on the basis of the following research. The second chapter expounds the related theories of secret investigation and privacy, mainly introduces the connotation and extension of privacy and analyzes the invasion of privacy by secret investigation. The author believes that there are differences in the content and degree of civil privacy infringed by secret investigative measures. At the same time, the author analyzes the legitimate reasons for secret investigation to enter the field of citizen privacy, and summarizes the concrete manifestation of secret investigation encroaching on citizen's privacy. The third chapter is the foreign investigation of privacy protection in secret investigation. Mainly referring to the legislation of the two countries on the main secret investigation measures, the judicial documents are how to regulate the secret investigation behavior and protect the citizens' right to privacy. The purpose of this chapter is to draw lessons from the standards of secret investigation legal system in foreign legal texts so as to benefit the construction of the local secret investigation system in accordance with the national conditions of our country. The fourth chapter is the analysis of the status quo, problems and reasons of privacy protection in the documents of our country's secret investigation, only based on the reality of our country, grasp the status quo of secret investigation as a whole, and analyze the existing problems and reasons. Only then can we put forward the legislative suggestion of secret investigation in accordance with the national conditions of our country. The fifth chapter puts forward legislative suggestions to improve the protection of privacy in the process of secret investigation in China. Based on the current legislation and practice of secret investigation in our country, and referring to the international standards, the author makes a distinction from the legislative principle of secret investigation, the principles to be observed in the legislation of secret investigation, the rights of the object of secret investigation and the relief system. The legal framework of privacy protection in secret investigation is constructed in four aspects of sanction mechanism of illegal investigation.
