【摘要】：辯護律師會見權作為律師辯護權中最核心的權利之一,在本次刑事訴訟法修改中占據(jù)了重要的位置,修改后的刑事訴訟法能夠更好地保障律師同犯罪嫌疑人、被告人會見,尤其是偵查階段的會見權利得到了進一步的完善。偵查階段辯護律師會見權利的完善能夠更好地體現(xiàn)我國刑事訴訟法保障人權和打擊犯罪的需要,更好地實現(xiàn)尊重和保障人權的重要任務。本文在介紹我國刑事偵查階段辯護律師會見權的相關法律規(guī)定和理論研究的基礎上,重點闡釋我國刑事偵查階段辯護律師會見權的進步及不足之處,進而分析我國偵查期問的辯護律師會見制度同國外偵查階段的律師會見制度之間的區(qū)別,結合我國的具體國情和司法實踐經(jīng)驗,深入剖析我國偵查階段辯護律師會見制度存在的缺陷以及對我國偵查階段辯護律師會見制度的繼續(xù)改革和完善提供有益參考。 本文主要分為以下四個部分。 第一部分：主要是對辯護律師會見權的概述。通過介紹會見權概念和歷史演進過程,分析會見制度的存在價值以及在訴訟進程和法治進步中的重要性。 第二部分：通過對國外和國際通行的辯護律師會見制度進行介紹和分析,總結國外偵查階段對辯護律師會見權的保障和限制條款,以期能為完善我國辯護律師會見制度提供一定的借鑒。 第三部分：從新刑事訴訟法和其他機關最近出臺的法律、法規(guī)和司法解釋的相關規(guī)定出發(fā),詳細分析新刑事訴訟法關于辯護律師會見制度的意義及存在的問題,對我國辯護律師會見權的實現(xiàn)程度進行深度剖析。 第四部分：針對偵查階段辯護律師會見過程中存在的問題,提出解決方案。在法律上明確賦予被追訴人會見權、合理設定會見權行使的界限、賦予辯護律師會見過程中錄音和錄像的權利、設立中立看守所制度等等。
[Abstract]:As one of the most important rights in lawyers' right of defense, the right of meeting with defense lawyers occupies an important position in the revision of the criminal procedure law. The amended criminal procedure law can better protect lawyers from meeting with criminal suspects and defendants. In particular, the right to meet in the investigation stage has been further improved. The perfection of defense lawyer's meeting right in investigation stage can better reflect the need of protecting human rights and cracking down on crime in our criminal procedure law, and realize the important task of respecting and protecting human rights better. Based on the introduction of the relevant legal provisions and theoretical research on the right of defense counsel to meet in the criminal investigation stage, this paper focuses on explaining the progress and deficiencies of the right of meeting defense counsel in the criminal investigation stage in our country. Then it analyzes the differences between the interview system of defense counsel in the investigation period of our country and the interview system of lawyers in the foreign investigation stage, and combines the specific situation of our country and the judicial practice experience. This paper deeply analyzes the defects of the defense counsel interview system in the investigation stage of our country and provides a useful reference for the further reform and improvement of the defense lawyer interview system in the investigation stage of our country. This article is divided into the following four parts. The first part is a summary of the right of defense counsel to meet. By introducing the concept and historical evolution of the right of meeting, this paper analyzes the existence value of the interview system and its importance in the process of litigation and the progress of the rule of law. The second part: through the introduction and analysis of the foreign and international defense lawyer meeting system, summarizes the foreign investigation stage to the defense lawyer meeting right safeguard and the restriction clause, In order to improve the meeting system of defense lawyers in China to provide certain reference. The third part: from the new criminal procedure law and other organs recently issued laws, regulations and judicial interpretation of the relevant provisions, detailed analysis of the new criminal procedure law on the system of defense counsel interview significance and existing problems, The realization degree of the right of meeting the defense lawyer in China is analyzed in depth. The fourth part: to solve the problems in the process of defense lawyer interview in investigation stage. In law, it gives the accused the right to meet, reasonably sets the limits of the exercise of the right to interview, endows the defense lawyer with the right of recording and video recording during the interview, and sets up the system of neutral detention center, and so on.
