【摘要】：正在刑事訴訟中,檢察機(jī)關(guān)收繳犯罪涉及的款物并依法依規(guī)處理,為不同訴訟環(huán)節(jié)辦理案件提供證據(jù),有利于揭露、證實(shí)和懲罰犯罪。但實(shí)際操作中,涉案財(cái)物的處理往往涉及公民合法權(quán)益的保護(hù),應(yīng)審慎對(duì)待。筆者立足于我國(guó)檢察機(jī)關(guān)辦案實(shí)際,擬對(duì)涉案財(cái)物處理中存在的問(wèn)題進(jìn)行分析并提出解決建議,以期對(duì)我國(guó)刑事訴訟制度的發(fā)展和涉案財(cái)物的權(quán)利保障有所裨
[Abstract]:In the criminal proceedings, the procuratorial organs collect the money and materials involved in the crime and deal with it according to the law, and provide evidence for handling cases in different lawsuit links, which is conducive to exposing, proving and punishing the crimes. However, in practice, the handling of property involved often involves the protection of citizens' legitimate rights and interests, and should be treated with caution. Based on the case handling practice of the procuratorial organs in China, the author intends to analyze the problems existing in the handling of the property involved in the case and put forward some suggestions to solve it, in order to help the development of the criminal procedure system and the protection of the rights of the property involved in the case.
