【摘要】：檢察權(quán)性質(zhì)、組織模式是影響檢察官懲戒制度建構(gòu)的重要因素。我國檢察權(quán)是偏向于司法權(quán)的混合性權(quán)力,這決定了我國適合建構(gòu)多層級的檢察官懲戒機(jī)制:對于可能危及檢察官身份的懲戒權(quán)限由中立和公正的第三方按照正當(dāng)程序行使,而對于不會危及檢察官身份的懲戒權(quán)限則由檢察機(jī)關(guān)自行掌控。我國在檢察官懲戒制度改革過程中,忽視了檢察權(quán)的混合權(quán)力特性,深受科層式檢察權(quán)組織模式的束縛,致使改革呈現(xiàn)出"原地踏步"的困境。要化解檢察官懲戒制度的改革困境,必須正視檢察權(quán)偏向于司法權(quán)的權(quán)力屬性,沖破科層式檢察權(quán)組織模式的束縛,進(jìn)而對檢察官懲戒制度改革走向予以正確的引導(dǎo)。
[Abstract]:The nature of procuratorial power and organization mode are the important factors that influence the construction of prosecutor's disciplinary system. The procuratorial power of our country is a mixed power in favor of the judicial power, which determines that our country is suitable for constructing a multi-level disciplinary mechanism for prosecutors: the disciplinary authority that may endanger the status of prosecutors is exercised by neutral and impartial third parties in accordance with due process. However, the power of punishment that does not endanger the status of procurators is controlled by the procuratorial organs themselves. In the process of the reform of procurator's disciplinary system, our country ignored the mixed power characteristic of procuratorial power, and was bound by the mode of organization of procuratorial power, which resulted in the dilemma of "standing still in place". In order to resolve the plight of the reform of the procurator's disciplinary system, we must face squarely the power attribute of procuratorial power to the judicial power, break through the bondage of the organization mode of procuratorial power, and then give correct guidance to the reform of the procurator's disciplinary system.
