【摘要】：庭審實(shí)質(zhì)化改革試點(diǎn)中,"意外"的裁判結(jié)果不斷出現(xiàn),其產(chǎn)生的真實(shí)原因是直接言詞的調(diào)查方式對書面調(diào)查方式的替代。證據(jù)調(diào)查方式變革的背后,是事實(shí)判斷的邏輯轉(zhuǎn)變。傳統(tǒng)庭審調(diào)查的邏輯認(rèn)為,偵查證據(jù)更加真實(shí)可信,而庭審實(shí)質(zhì)化的邏輯則認(rèn)為,偵查證據(jù)并不完全值得信賴,通過直接言詞方式的調(diào)查、采用個(gè)別化的證據(jù)審查判斷方法更容易查明案件事實(shí)真相。實(shí)踐中,影響證據(jù)真實(shí)性的主要因素有三方面:人證的認(rèn)知規(guī)律,提供證據(jù)主體的動(dòng)機(jī),以及偵查人員的取證方式。無論從哪方面因素看,認(rèn)定偵查證據(jù)優(yōu)于庭審證據(jù)的觀點(diǎn)都難以成立,實(shí)質(zhì)化的法庭調(diào)查相比傳統(tǒng)的法庭調(diào)查更有利于查明案件事實(shí)真相。庭審實(shí)質(zhì)化改革的本質(zhì)是以實(shí)質(zhì)真實(shí)觀替代形式真實(shí)觀,以審判卷宗替代偵查卷宗,從而擺脫偵查證據(jù)對審判的決定作用,使刑事程序真正從以偵查為中心轉(zhuǎn)變?yōu)橐詫徟袨橹行摹?br/>[Abstract]:In the trial of trial reform, the result of "unexpected" judgment appears constantly, and the real reason is the substitution of the way of direct words investigation to the way of written investigation. Behind the change of evidence investigation is the logical change of fact judgment. The logic of the traditional trial investigation holds that the investigative evidence is more truthful and credible, while the logic of the trial substance believes that the investigative evidence is not entirely trustworthy. It is easier to find out the truth of the case by individualized evidence review method. In practice, there are three main factors influencing the authenticity of evidence: the cognitive law of the witness, the motive of providing the main body of evidence, and the way of obtaining evidence by investigators. It is difficult to hold the view that the investigation evidence is superior to the trial evidence, and the substantial court investigation is more helpful than the traditional court investigation to find out the truth of the case. The essence of the reform of the essence of the trial is to replace the formal view of truth with the view of substantive truth, and to replace the investigation file with the trial file, so as to get rid of the decisive role of the investigative evidence in the trial. Make the criminal procedure really change from the investigation as the center to the trial as the center.
