【摘要】：現(xiàn)實(shí)生活中,司法裁判承載著糾紛解決、社會(huì)行為規(guī)范、社會(huì)價(jià)值引導(dǎo)等多元功能。因此,裁判文書(shū)應(yīng)當(dāng)充分發(fā)揮其說(shuō)理特性,將案件爭(zhēng)議、事實(shí)、證據(jù)與法律規(guī)則之間的關(guān)聯(lián)及其相互影響進(jìn)行精確的分析和闡釋。裁判說(shuō)理的好壞,主要取決于說(shuō)理能力、說(shuō)理環(huán)境以及說(shuō)理載體�，F(xiàn)階段,我國(guó)應(yīng)當(dāng)將完善說(shuō)理載體作為加強(qiáng)裁判說(shuō)理的首要路徑。完善說(shuō)理載體,不應(yīng)盲目采取司法移植的路徑,而應(yīng)當(dāng)在參考域外經(jīng)驗(yàn)的基礎(chǔ)上,對(duì)我國(guó)說(shuō)理載體的"構(gòu)件"進(jìn)行拆分,并以現(xiàn)行民事訴訟立法和裁判說(shuō)理的規(guī)律為指導(dǎo),對(duì)拆分后的"要素"進(jìn)行重組,繼而準(zhǔn)確定位重組后各"構(gòu)件"的功能,創(chuàng)制出有利于說(shuō)理的文書(shū)載體形式,提升我國(guó)裁判的說(shuō)理性。
[Abstract]:In real life, judicial adjudication carries multiple functions such as dispute resolution, social behavior norms and social value guidance. Therefore, the adjudicative document should give full play to its reasoning characteristics, and accurately analyze and explain the relation and mutual influence between the dispute, the fact, the evidence and the rule of law. The good or bad judgment reasoning mainly depends on the reasoning ability, the reasoning environment and the reasoning carrier. At present, our country should take the perfect reasoning carrier as the primary path to strengthen the judgment reasoning. To perfect the theory carrier, we should not blindly adopt the path of judicial transplantation, but should split the "component" of our country's reasoning carrier on the basis of reference to the overseas experience, and take the current civil litigation legislation and the law of judgment reasoning as the guidance. This paper recombines the "elements" after splitting, and then accurately locates the function of each "component" after the reorganization, creates the form of the document carrier which is beneficial to the reasoning, and promotes the rationality of the judgment in our country.
