【摘要】：刑事和解制度的核心是被害人諒解,其外延是加害人群體和受害人群體的"合意"。眾多社會(huì)關(guān)系人的參與為刑事和解營造了濃厚的社會(huì)氛圍,為對刑事和解制度進(jìn)行社會(huì)學(xué)分析提供了方便。中國刑事和解制度的傳統(tǒng)根基是中國傳統(tǒng)社會(huì)根基的延續(xù),它必然受到中國傳統(tǒng)文化和傳統(tǒng)訴訟觀念的影響。國家刑事政策、刑事立法、刑事司法的支撐以及糾紛民間解決機(jī)制的廣泛存在是中國刑事和解制度賴以生存的現(xiàn)實(shí)土壤。而刑事和解制度的社會(huì)效用則體現(xiàn)在其助益于受害人群體和加害人群體的回歸,從而盡可能地修復(fù)社會(huì)關(guān)系,并同時(shí)實(shí)現(xiàn)節(jié)約社會(huì)成本的功效。
[Abstract]:The core of criminal reconciliation system is victim understanding, and its extension is the "agreement" of victimizer group and victim group. The participation of many social relations creates a strong social atmosphere for criminal reconciliation and provides convenience for sociological analysis of criminal reconciliation system. The traditional foundation of Chinese criminal reconciliation system is the continuation of Chinese traditional social foundation, which is bound to be influenced by Chinese traditional culture and traditional litigation idea. The support of national criminal policy, criminal legislation, criminal judicature and the widespread existence of folk dispute settlement mechanism are the realistic soil on which China's criminal reconciliation system depends. The social utility of the criminal reconciliation system is reflected in its benefit to the return of the victims and perpetrators, so as to repair the social relations as far as possible, and at the same time realize the effect of saving the social cost.
