【摘要】：法律現(xiàn)實(shí)主義不僅對(duì)刑事司法的制度構(gòu)建產(chǎn)生了重要影響,而且對(duì)刑事裁判的產(chǎn)生過程也具有實(shí)質(zhì)性意義�，F(xiàn)實(shí)主義刑事司法以理性選擇作為人性基礎(chǔ),近年來受到德性主義之詰問。刑事司法的過程是一種理性選擇但不能僅僅是一種理性選擇,其必須經(jīng)過實(shí)踐理性的洗禮并逐步形塑德性的共識(shí),最終形成基于法律職業(yè)共同體的公平、正義等內(nèi)在德性認(rèn)同的理想刑事司法模式。
[Abstract]:Legal realism not only has an important influence on the construction of criminal justice system, but also has substantial significance to the process of criminal adjudication. Realistic criminal justice is based on rational choice and has been questioned by virtue in recent years. The process of criminal justice is a rational choice, but not just a rational choice. It must be baptized by practical reason and gradually shape the consensus of morality, and finally form the fairness based on the legal professional community. The ideal criminal justice model of justice and other internal virtue identity.
