【摘要】：正法官耐心傾聽而不是參加爭辯,是作出正確判斷的重要前提。始終保持沉著鎮(zhèn)靜、彬彬有禮,無論行動還是安坐,都能給人以內(nèi)斂克制的感覺才好,這是聽訟者應(yīng)有的素養(yǎng)和氣度近來我國司法公信力受到不少質(zhì)疑,法官與各方的關(guān)系也出現(xiàn)一些不太正常的情形。比如,在刑事訴訟中,對抗的本應(yīng)是控辯兩方,現(xiàn)如今卻是法官和律師的沖突愈演愈烈;在民事訴訟中,真正對抗的是原告和被告,法官只需耐心聽取雙方陳述和辯論,等雙方辯出個輸贏,論出個高低,掌握個"火候",適時而堅定
