【摘要】：司法責任制的制度理性主要體現于司法責任制構建的人學制度基礎,司法責任制中責任包含的積極內涵,司法責任制中隱含的法治命題,以及司法責任制作為促進司法進化的核心變量等四項內容之中。司法責任制決定了司法體制改革的基本邏輯,是矛盾論和實踐論螺旋式上升的基點。司法責任制在整個司法體制改革中起到提綱挈領、綱舉目張的作用,使司法體制改革趨于全面、深刻和徹底。
[Abstract]:The institutional rationality of the judicial responsibility system is mainly embodied in the foundation of the humanistic system of the judicial responsibility system, the positive connotation of the responsibility contained in the judicial responsibility system, and the proposition of the rule of law implied in the judicial responsibility system. And judicial responsibility system as the core variable to promote judicial evolution and other four content. Judicial responsibility system determines the basic logic of judicial system reform and is the basic point of spiral rise of contradiction theory and practice theory. Judicial responsibility system plays an important role in the reform of the whole judicial system, which makes the reform of judicial system more comprehensive, profound and thorough.
