【摘要】：為確保司法監(jiān)督的有效性,死刑復(fù)核程序確立全面審查原則。近年來(lái)為了提高死刑辦案質(zhì)量,死刑復(fù)核全面審查原則被進(jìn)一步強(qiáng)化。但從死刑復(fù)核實(shí)踐中不核準(zhǔn)率下降以及不核準(zhǔn)事由越來(lái)越集中于死刑適用不當(dāng)來(lái)看,全面審查原則在確保死刑案件辦案質(zhì)量方面的作用下滑。這與證據(jù)裁判的確立、控辯雙方的參與有關(guān)。全面審查原則對(duì)刑事司法程序和刑事司法結(jié)構(gòu)的沖擊逐漸凸顯,如全面審查原則帶來(lái)刑事訴訟程序重心上移,也使得最高人民法院不堪重負(fù),增加最高人民法院的政治風(fēng)險(xiǎn)。我們可以借鑒有限審查的做法,將死刑復(fù)核全面審查改造為重點(diǎn)審查。
[Abstract]:In order to ensure the effectiveness of judicial supervision, the death penalty review procedure establishes a comprehensive review principle. In recent years, in order to improve the quality of the death penalty case, the principle of the comprehensive review of the death penalty review has been further strengthened. But the principle of comprehensive review is confirmed by the fact that the rate of non approval and the disapproval of the death penalty are more and more concentrated on the improper application of the death penalty. This is related to the establishment of the evidence referee and the participation of both the prosecution and the defense. The impact of the comprehensive review principle on the criminal judicial procedure and the criminal judicial structure has been gradually highlighted, such as the shift of the center of gravity of the criminal procedure, which makes the Supreme People's court overburden, and the highest increase. The political risks of the people's courts can be learned from the practice of limited censorship, and the review of death sentences should be reviewed and transformed as a key examination.
