【摘要】：近期,貴州省金沙縣檢察院以原告的身份把金沙縣環(huán)保局告上法院,此案可以看作是我國環(huán)境行政公益訴訟的"破冰"之舉。本文以該訴訟涉及的各個主體為基礎,對此案例所反映環(huán)境行政公益訴訟理論和實踐方面的積極意義進行分析和闡述,并在此基礎之上提出我國環(huán)境行政公益訴訟今后發(fā)展中需要注意的問題,以使環(huán)境行政公益訴訟在今后保障環(huán)境公益方面發(fā)揮更為積極之作用。
[Abstract]:Recently, the Jinsha County Procuratorate of Guizhou Province took the Jinsha County Environmental Protection Bureau to court as a plaintiff. This case can be regarded as an "ice-breaking" act of environmental administrative public interest litigation in China.Based on the subjects involved in the lawsuit, this paper analyzes and expounds the positive significance of the theory and practice of environmental administrative public interest litigation reflected in this case.On this basis, the paper puts forward some problems that should be paid attention to in the future development of environmental administrative public interest litigation in China, so that environmental administrative public interest litigation can play a more active role in protecting environmental public welfare in the future.
