【摘要】：2012年8月，新修訂的民事訴訟法明確規(guī)定了當(dāng)事人有權(quán)申請具有專門知識的人出庭對涉案的專業(yè)問題提出意見。這樣的立法舉措是因為：一方面，越來越多涉及專業(yè)問題的糾紛涌入法院，法官對鑒定結(jié)論的高度依賴使得當(dāng)事人對審判結(jié)果多有不滿，損害了是司法正義和司法權(quán)威；另一方面，隨著當(dāng)事人訴訟權(quán)利意識的蘇醒，在案件審理的過程中，當(dāng)事人更加注重是否得到公平的待遇。引入專家輔助人制度使得當(dāng)事人擁有足以抗衡鑒定意見的機(jī)會；最后，在民事訴訟更加注重當(dāng)事人主義的實(shí)現(xiàn)時，專家輔助人制度能夠更好地平衡雙方當(dāng)事人的利益，實(shí)現(xiàn)有效的對抗。但是，由于法律對專家輔助人制度只進(jìn)行了原則性規(guī)定，筆者從專家輔助人的概念出發(fā)，深入分析探討專家輔助人的制度建設(shè)。本文主要分為以下四個部分： 第一部分，對我國民事訴訟中專家輔助人制度的進(jìn)行概述。首先，對專家輔助人的概念及其特征進(jìn)行分析和論述。然后，深入分析我國專家輔助人制度的立法背景，包括當(dāng)事人不能對涉案的專業(yè)問題進(jìn)行有效分析、當(dāng)事人無法對鑒定意見作出有效質(zhì)證等。再次，本文將立法內(nèi)容出發(fā)，，列舉我國現(xiàn)行法律中涉及專家輔助人的內(nèi)容。最后，在這立法背景下，進(jìn)一步探討專家輔助人制度存在的問題。 第二部分，深入研究專家輔助人的訴訟地位及作用，這是本文的重點(diǎn)部分。由于我國立法還沒明確專家輔助人的訴訟地位，學(xué)界與司法界對專家輔助人的具體訴訟地位有不同看法，因此，明確專家輔助人的訴訟地位顯得尤其重要。為此，筆者也提出了關(guān)于專家輔助人訴訟地位的看法，并對此進(jìn)行了詳細(xì)的說明。最后，在確定專家輔助人訴訟地位的基礎(chǔ)上，明確提出專家輔助人意見的作用。 第三部分，深入探究專家輔助人制度的內(nèi)容，這也是本文的重要部分。本章主要從實(shí)體和程序兩方面來論述專家輔助人制度的內(nèi)容。在具體規(guī)范方面，主要論述了專家輔助人資格與審查、權(quán)利與義務(wù)、專家輔助人的法律責(zé)任等。這為下面的程序構(gòu)建打下了堅實(shí)的基礎(chǔ)。在方式和程序方面，主要是專家輔助人制度的啟動、專家輔助人的退出與救濟(jì)及其證據(jù)的可采性等方面進(jìn)行詳細(xì)的論述。 第四部分，對完善我國專家輔助人制度的其他保障性措施提出建議。首先，要保障專家輔助人的知情權(quán)與參與權(quán)；其次，要加強(qiáng)專家輔助人的行業(yè)管理；再次，重視專家輔助人的人身安全保障；第四，要明確專家輔助人的費(fèi)用標(biāo)準(zhǔn)。
[Abstract]:In August 2012, the newly amended Code of Civil procedure expressly provided that the parties had the right to apply for a person with expertise to appear in court to comment on the professional issues involved.Such legislative measures are: on the one hand, more and more disputes involving professional issues pour into the court, and judges rely heavily on the conclusion of the appraisal, which makes the parties dissatisfied with the trial results, and damages the judicial justice and judicial authority;On the other hand, with the awakening of litigant's right consciousness, the litigants pay more attention to fair treatment.The introduction of the expert Auxiliary system enables the parties to have sufficient opportunities to counteract the opinions of the appraisal. Finally, when the civil litigation pays more attention to the realization of litigant doctrine, the expert Auxiliary system can better balance the interests of both parties.To achieve effective confrontation.However, since the law only provides for the system of expert assistant in principle, the author proceeds from the concept of expert assistant, and deeply analyzes and discusses the system construction of expert assistant.This paper is divided into the following four parts:The first part is an overview of the system of expert auxiliaries in civil litigation in China.First of all, the concept and characteristics of expert assistant are analyzed and discussed.Then, the author deeply analyzes the legislative background of our country's expert assistant system, including that the parties cannot effectively analyze the professional problems involved in the case, and the parties cannot make effective cross-examination of the appraisal opinions and so on.Thirdly, this paper enumerates the contents of the current law of our country which involve the expert assistant.Finally, under this legislative background, further discusses the question which the expert assistant person system exists.In the second part, the author deeply studies the action status and function of the expert assistant, which is the key part of this paper.Due to the fact that the litigation status of the expert assistant is not clear in our country's legislation, the academic and judicial circles have different views on the specific litigation status of the expert assistant, so it is particularly important to clarify the litigation status of the expert assistant.Therefore, the author also puts forward the views on the status of the expert assistant litigant, and explains it in detail.Finally, on the basis of determining the litigation status of the expert assistant, the role of the expert assistant opinion is clearly put forward.The third part explores the content of expert assistant system, which is also an important part of this paper.This chapter mainly discusses the content of expert assistant system from two aspects of entity and procedure.In the specific specification, it mainly discusses the qualification and examination, rights and obligations, the legal responsibility of the expert assistant and so on.This lays a solid foundation for the following program building.In the aspect of way and procedure, it mainly discusses the initiation of expert assistant system, the withdrawal and relief of expert assistant and the admissibility of evidence.The fourth part, to perfect our country expert assistant person system other safeguard measure puts forward the proposal.First of all, to protect the right to know and participate in the right of expert assistant; secondly, to strengthen the industry management of expert assistant; thirdly, to attach importance to the personal security of expert assistant; fourth, to make clear the cost standard of expert assistant.
