【摘要】：正在如火如荼進(jìn)行中的PPP模式,有力推地動(dòng)了我國(guó)公用事業(yè)的快速發(fā)展,但也暴露出諸多問題,并對(duì)傳統(tǒng)政府監(jiān)管提出了挑戰(zhàn)�，F(xiàn)代政府監(jiān)管應(yīng)當(dāng)從監(jiān)管理念、目標(biāo)、方式和法律救濟(jì)等方面進(jìn)行適當(dāng)轉(zhuǎn)型。在監(jiān)管理念上,傳統(tǒng)嚴(yán)格監(jiān)管的理念已經(jīng)不符合PPP模式的本質(zhì)要求,應(yīng)引入市場(chǎng)競(jìng)爭(zhēng)機(jī)制,逐步打破行業(yè)壟斷。在監(jiān)管目標(biāo)上,核心是如何正確處理好公共利益和私人利益的關(guān)系,應(yīng)更加注重對(duì)私人利益的保護(hù),以提高私人部門參與的積極性。在監(jiān)管方式上,應(yīng)打破主要倚重行政許可等事前監(jiān)管手段的傳統(tǒng),充分發(fā)揮事中、事后監(jiān)管的優(yōu)勢(shì)。在法律救濟(jì)上,應(yīng)重新審視傳統(tǒng)救濟(jì)途徑所存在的不足,處理好民事訴訟與行政訴訟之間的關(guān)系,并努力將仲裁打造成PPP糾紛解決的主渠道。
[Abstract]:The PPP model, which is in full swing, has pushed forward the rapid development of public utilities in our country, but it has also exposed many problems and challenged the traditional government supervision. In the aspect of supervision idea, the traditional idea of strict supervision does not accord with the essential requirement of PPP mode, so the market competition mechanism should be introduced to break the monopoly of the industry step by step. The core is how to properly handle the relationship between public and private interests, and pay more attention to the protection of private interests in order to increase the participation of the private sector. It is necessary to break the tradition of relying mainly on prior supervision means such as administrative license, and give full play to the advantages of supervision after the event. In terms of legal relief, we should re-examine the shortcomings of the traditional ways of relief. Deal with the relationship between civil litigation and administrative litigation, and try to build arbitration as the main channel of PPP dispute resolution.
