【摘要】:警察行政即時(shí)強(qiáng)制措施是行政強(qiáng)制研究領(lǐng)域一個(gè)重要組成部分。由于其權(quán)力設(shè)置上的行政性、緊急性和侵犯性,一旦行使不當(dāng),容易對(duì)公民基本人權(quán)造成重大威脅。然而,令人遺憾的是,中華人民共和國(guó)行政強(qiáng)制法(以下簡(jiǎn)稱《行政強(qiáng)制法》)中并沒(méi)有對(duì)于行政即時(shí)強(qiáng)制進(jìn)行規(guī)定。時(shí)至今日,在我國(guó)對(duì)于即時(shí)強(qiáng)制措施仍然缺乏統(tǒng)一的立法。有關(guān)警察行政即時(shí)強(qiáng)制的法律依據(jù),僅能散見(jiàn)于《人民警察法》等單行的法律法規(guī)中,因此導(dǎo)致我國(guó)的行政即時(shí)強(qiáng)制措施的執(zhí)行約束體系不夠系統(tǒng),有待細(xì)化。此外,目前關(guān)于公安警察部門法中警察行政即時(shí)強(qiáng)制措施的研究并不夠深入,在實(shí)踐中仍然存在很多問(wèn)題。諸如因警察行政即時(shí)強(qiáng)制措施行使不當(dāng)致使公民的自由、權(quán)利、財(cái)產(chǎn)被侵害的事件,頻頻發(fā)生。因此,在建立以保障人的基本權(quán)利和自由為目標(biāo)的法治國(guó)家過(guò)程中,我們必須對(duì)警察行政即時(shí)強(qiáng)制措施在行政法學(xué)研究中予以重視,以期能為實(shí)現(xiàn)嚴(yán)格規(guī)制警察行政即時(shí)強(qiáng)制措施的行使,防止其濫用,從而更好地保障公共安全和社會(huì)秩序,保障行政相對(duì)人的合法權(quán)益的目標(biāo)提供理論支持。 本文共分引言、正文和結(jié)語(yǔ)三個(gè)部分,正文包括以下四部分: 第一部分著重于闡述有關(guān)警察行政即時(shí)強(qiáng)制措施的基礎(chǔ)理論。本文從界定警察行政、即時(shí)強(qiáng)制、警察行政即時(shí)強(qiáng)制措施的等概念入手,分析了我國(guó)警察行政即時(shí)強(qiáng)制措施的特征、種類及法律依據(jù)。該部分構(gòu)成了本文探討警察行政即時(shí)強(qiáng)制措施及其適用與完善的基礎(chǔ)和邏輯起點(diǎn)。 第二部分對(duì)域外和我國(guó)臺(tái)灣地區(qū)警察行政即時(shí)強(qiáng)制措施的制度進(jìn)行了對(duì)比考察。通過(guò)對(duì)德國(guó)、日本、韓國(guó)和我國(guó)臺(tái)灣地區(qū)即時(shí)強(qiáng)制措施的制度分析,本文總結(jié)了法治相對(duì)先行國(guó)家和地區(qū)警察行政即時(shí)強(qiáng)制措施的成功經(jīng)驗(yàn),包括警察行政即時(shí)強(qiáng)制措施細(xì)致入微,強(qiáng)制措施的種類齊全和高度注重人權(quán)的保障措施。 第三部分用于分析我國(guó)警察行政即時(shí)強(qiáng)制措施中現(xiàn)存的問(wèn)題,譬如立法不完善、執(zhí)法主體良莠不齊、違法責(zé)任追究機(jī)制不健全等等。 第四部分則著筆于探討警察行政即時(shí)強(qiáng)制的司法審查中應(yīng)該注意的問(wèn)題。在此部分,本文主要圍繞著如何進(jìn)行合理性審查、舉證上的特殊要求、復(fù)議前置、起訴期限、行政復(fù)議、行政訴訟、特別損失補(bǔ)償?shù)确矫鎭?lái)展開(kāi)論述。 簡(jiǎn)而言之,為確保警察行政即時(shí)強(qiáng)制措施在其行使中實(shí)現(xiàn)有法可依、有法必依、執(zhí)法必嚴(yán)、違法必究,我國(guó)需要不斷改進(jìn)強(qiáng)化現(xiàn)有的司法審查體系,,從而更好的保障行政相對(duì)人的合法權(quán)益,并推動(dòng)我國(guó)法制建設(shè)的進(jìn)程。
[Abstract]:The police administrative immediate coercive measures are an important part of the research field of administrative compulsion. Due to the administrative, urgent and intrusive nature of its power establishment, it is easy to pose a serious threat to the basic human rights of citizens once it is improperly exercised. It is regrettable that the Administrative compulsory Law of the people's Republic of China (hereinafter referred to as the Administrative compulsory Law) does not provide for immediate administrative coercion. In China, there is still a lack of uniform legislation on immediate coercive measures. The legal basis for the immediate enforcement of police administration can only be found in separate laws and regulations such as the people's Police Law. As a result, the enforcement constraint system of administrative immediate coercive measures in our country is not systematic enough and needs to be refined. In addition, the current research on the police administrative immediate coercive measures in the Public Security Police Department Law is not deep enough. There are still many problems in practice, such as the frequent violation of citizens' freedom, rights and property as a result of improper enforcement of the police's immediate administrative coercive measures. In the process of establishing a country under the rule of law with the goal of safeguarding the fundamental rights and freedoms of human beings, we must attach importance to the immediate coercive measures of police administration in the study of administrative jurisprudence. In order to achieve strict regulation of the exercise of police administrative immediate coercive measures, prevent their abuse, and thus better protect public security and social order, to protect the legitimate rights and interests of administrative counterpart to provide theoretical support. This paper is divided into three parts: introduction, text and conclusion. The text includes the following four parts:. The first part focuses on the basic theory of police administrative immediate coercive measures. This paper begins with the definition of police administration, immediate enforcement, police administrative immediate coercive measures, and so on. This paper analyzes the characteristics, types and legal basis of the immediate coercive measures of police administration in China. This part constitutes the basis and logical starting point for the discussion of the immediate coercive measures of the police administration and their application and perfection. In the second part, the author makes a comparative study on the system of immediate coercive measures of police administration in Taiwan and abroad. Through the analysis of the system of immediate coercive measures in Germany, Japan, South Korea and Taiwan, This paper summarizes the successful experience of the immediate enforcement measures of police administration in countries and regions where the rule of law is relatively advanced, including the meticulous enforcement measures of the police administration, the complete range of coercive measures and the protection measures that attach great importance to human rights. The third part is used to analyze the existing problems in the police administrative immediate coercive measures, such as imperfect legislation, mixed law enforcement subjects, imperfect accountability mechanism and so on. The fourth part focuses on the problems that should be paid attention to in the judicial review of the police administrative prompt compulsion. In this part, this article mainly focuses on how to carry out the rationality review, the special requirements on the proof, the review before, the time limit for the prosecution. Administrative reconsideration, administrative litigation, special loss compensation and so on. In short, in order to ensure that the police administrative immediate enforcement measures have laws to abide by, must abide by the law, enforce the law strictly, and prosecute violations of the law, our country needs to constantly improve and strengthen the existing judicial review system. In order to better protect the legitimate rights and interests of the administrative counterpart, and promote the process of legal construction in China.
