【摘要】：自《公安機(jī)關(guān)適用繼續(xù)盤問規(guī)定》實(shí)施以來,部分基層公安機(jī)關(guān)很少甚至不再適用繼續(xù)盤問措施,而是根據(jù)案件性質(zhì)決定適用行政或者刑事傳喚、拘傳,繼續(xù)盤問措施空置化現(xiàn)象已經(jīng)相當(dāng)嚴(yán)重。為此,應(yīng)分析繼續(xù)盤問空置化的現(xiàn)狀和原因,研究空置化的后果。為充分利用好繼續(xù)盤問措施來履行警察職責(zé),就要解決繼續(xù)盤問空置化問題,應(yīng)從四個(gè)方面入手:一是要明確繼續(xù)盤問的法律性質(zhì);二是要強(qiáng)調(diào)違法犯罪嫌疑人到案措施的合法性,對(duì)非法適用到案措施所取證據(jù)予以排除;三是要細(xì)化繼續(xù)盤問措施的相關(guān)規(guī)定;四是要提高《繼續(xù)盤問規(guī)定》適用的可操作性。
[Abstract]:Since the implementation of the "provisions on continuous interrogation by Public Security organs", some grass-roots public security organs have rarely or even ceased to apply the measures of continuing cross-examination, but have decided to apply administrative or criminal summons and arrest according to the nature of the case. The phenomenon of continuous interrogation is already quite serious. Therefore, it is necessary to analyze the present situation and reasons of continuing cross-examination, to study the consequences of the vacancy, and to make full use of the continuous interrogation measures to perform the duties of the police. In order to solve the problem, we should start from four aspects: first, we should make clear the legal nature of the continuous cross-examination; second, we should emphasize the legality of the illegal suspect to the case, and exclude the evidence obtained from the illegal application of the measure to the case. The third is to refine the relevant provisions of the measures of continuous cross-examination, and the fourth is to improve the operability of the application of the provisions of continuous cross-examination.
