【摘要】：修訂后刑訴法專門規(guī)定了未成年人特別程序。這些關(guān)于特別程序的規(guī)定在實(shí)踐中如何運(yùn)行才能真正體現(xiàn)未成年人特殊保護(hù)的宗旨,是司法實(shí)踐中面臨的重大課題。對(duì)實(shí)踐中存在的合適成年人到場(chǎng)簽字形式化問題,應(yīng)當(dāng)設(shè)立"合適成年人雙次談話制度"予以解決。未成年人刑事訴訟中形成的各種非證據(jù)材料不宜入案件主卷。要注意通過權(quán)利充分告知、法規(guī)講解,細(xì)化法律援助制度,保障未成年人訴訟權(quán)利。
[Abstract]:The revised criminal procedure law stipulated the special procedures of minors. These Provisions on special procedures in practice how to truly reflect the minors special protection purposes, is an important issue in the judicial practice. On the right of adults in practice to sign a formal problem, it should be set up a "appropriate adult double conversation system" to solve the minors. All forms in the criminal procedure of non evidence should not be the main into the case volume. We must pay attention to the rights fully informed, regulations on refinement of the legal aid system, protection of juvenile rights litigation.
