【摘要】：常規(guī)的偵查過多地依賴于警力資源,大大降低偵破案件的效率和質(zhì)量,增加訴訟成本。而秘密偵查在案件偵破方面具有許多顯著地優(yōu)勢(shì),是應(yīng)對(duì)各類疑難案件的重要偵查手段。雖然刑事訴訟法沒有明確規(guī)定秘密偵查,但秘密偵查措施已被廣泛運(yùn)用于刑事司法實(shí)踐。從我國當(dāng)下社會(huì)發(fā)展?fàn)顟B(tài)和刑事犯罪特點(diǎn)來說,采用秘密偵查既可以提高法律效率,但又由于秘密偵查其手段隱秘,并以獲取未被公開的信息為目的,對(duì)隱私權(quán)可能造成破壞。因此,規(guī)制秘密偵查使其法治化是非常必要的。論文以《刑事訴訟法》中有關(guān)秘密偵查的規(guī)定為背景,結(jié)合國際社會(huì)與世界各國有關(guān)秘密偵查的法律規(guī)范化狀況,分析《刑事訴訟法》在相關(guān)方面的不足,從立法的層面講,當(dāng)前我國有關(guān)秘密偵查措施的法律法規(guī)仍比較欠缺,這也給具體偵查活動(dòng)帶來了很大的不便。提出了完善秘密偵查法治化的構(gòu)想和建議,著重對(duì)《刑事訴訟法》關(guān)于秘密偵查的立法進(jìn)行了評(píng)析并提出了修正意見。除此之外,筆者認(rèn)為單純完善立法規(guī)定還是遠(yuǎn)遠(yuǎn)不夠的,還應(yīng)從立法模式、配套制度上全面入手,才能實(shí)現(xiàn)我國秘密偵查真正的法律規(guī)制。對(duì)此,我們可吸收和借鑒域外的立法經(jīng)驗(yàn),盡快填補(bǔ)我國在此方面的法律空缺,從而豐富我國的偵查手段,提高案件的偵破效率和質(zhì)量。
[Abstract]:Conventional investigation relies too much on police resources, greatly reduces the efficiency and quality of detection cases, and increases the cost of litigation. But secret investigation has many significant advantages in the detection of cases. It is an important investigative technique to deal with all kinds of difficult cases, although the criminal procedure law does not specify secret investigation. However, secret investigation measures have been widely used in criminal judicial practice. From the current state of social development and criminal characteristics of our country, the use of secret investigation can improve the legal efficiency. But because the secret investigation means secret, and in order to obtain unpublished information for the purpose, may cause damage to the right of privacy. It is very necessary to regulate secret investigation by law. This paper takes the regulation of secret investigation in Criminal procedure Law as the background, and combines with the international community and the countries of the world to standardize the law of secret investigation. Analysis of the shortcomings of the Criminal procedure Law in the relevant aspects, from the legislative level, the current laws and regulations on secret investigation measures in China is still relatively lacking. This has also brought great inconvenience to the specific investigation activities, and put forward the idea and suggestion to perfect the secret investigation by law. Emphasis on the "Code of Criminal procedure" on the secret investigation of the legislation is evaluated and proposed amendments. In addition, the author thinks that it is not enough to perfect the legislative provisions, but also from the legislative model. In order to realize the real legal regulation of secret investigation in our country, we can absorb and learn from the foreign legislative experience, and fill the legal vacancy in this respect as soon as possible. In order to enrich our investigative techniques, improve the efficiency and quality of case detection.
