【摘要】：在現(xiàn)代社會,公民的精神權(quán)利越來越受到重視,精神健康已經(jīng)成為人們健康生活的重要組成部分,保護公民的精神權(quán)利不受侵犯是法律的重要職責。我國的民事法律規(guī)范對公民遭受的精神損害予以承認和支持,但是在刑事附帶民事訴訟中卻不允許被害人提出精神損害賠償?shù)恼埱�。刑事犯罪類案件作為一種破壞國家秩序、危害公民人身安全的活動應當受到法律的嚴懲,然而在現(xiàn)實生活中,這一些刑事案件不但侵害了公民的個人財產(chǎn)、身體健康,而且對被害人或者死者近親屬的精神也造成了巨大的打擊,他們的精神權(quán)益也應該受到法律的保護。 文章的引言部分是通過對一起交通肇事案受害人精神損害賠償糾紛的介紹和評析,引出目前我國關(guān)于刑事附帶民事訴訟中被害人精神損害賠償?shù)睦碚撗芯俊１疚墓卜秩齻�部分。 第一部分主要是對精神損害、精神損害賠償、刑事附帶民事訴訟中精神損害賠償?shù)母拍詈吞卣鬟M行概述,通過比較各個概念之間的區(qū)別和聯(lián)系能夠?qū)π淌掳讣缓θ司駬p害賠償有初步的認識。 第二部分是本文的重點。首先,介紹了我國目前關(guān)于刑事被害人精神損害賠償?shù)牧⒎ㄒ?guī)定、司法解釋、審判實踐和相關(guān)的理論學說。其次,分析其中存在的問題和不足之處。最后,是通過結(jié)合國外刑事案件被害人精神損害賠償?shù)牧⒎ㄚ厔莺臀覈默F(xiàn)實情況論證我國確立此項制度的必要性與合理性。 第三部分是對我國刑事案件被害人精神損害賠償?shù)乃伎己土⒎ńㄗh。一方面完善相關(guān)的法律法規(guī),賦予刑事被害人精神損害賠償?shù)臋?quán)利；另一方面通過建立健全國家救助和社會援助體系來解決法院執(zhí)行難和全面保護被害人精神損害的問題。然后再次闡述在我國確立刑事附帶民事訴訟中精神損害賠償制度是對公民權(quán)利的重視和法律價值的回歸。
[Abstract]:In modern society , citizen ' s spiritual rights are paid more and more attention , mental health has become an important part of people ' s healthy life , protecting the spiritual rights of citizens is not the important duty of law . However , in the incidental civil action in China , the victim should be punished severely . However , in the real life , the criminal cases not only violate the individual property and health of the citizens , but also cause great blow to the victim or close relatives of the deceased . Their spiritual rights and interests should also be protected by law . The introduction part of the article is the introduction and analysis of the compensation dispute of the victim ' s mental damages in the case of the accident of traffic accident , and draws out the current theory research on the victim ' s moral damage compensation in the criminal incidental civil action . The first part provides an overview of the concept and characteristics of mental damage compensation in civil litigation with mental damage , mental damage and incidental civil action , and it is possible to make a preliminary understanding of the victim ' s moral damages in criminal cases by comparing the differences and links between the concepts . The second part is the focus of this article . Firstly , the author introduces the legislative provisions , judicial interpretation , trial practice and relevant theoretical theories about the compensation of the victim ' s mental damages in China . Secondly , the problems and deficiencies are analyzed . Finally , the necessity and rationality of establishing the system by combining the legislative trend of the victim ' s mental damage compensation in foreign criminal cases and the reality of our country are discussed . The third part is the thought and the legislative suggestion on the compensation of the victim ' s mental damages in China ' s criminal cases . On the one hand , the relevant laws and regulations are perfected , the right of compensation for the moral damages of the victims is given . On the other hand , through establishing and perfecting the national salvation and social assistance system , the problem of the court ' s implementation of the difficult and comprehensive protection of the victim ' s mental harm is solved .
