【摘要】：我國刑事涉案財(cái)物處置在司法實(shí)踐中存在突出問題:為保障被害人的經(jīng)濟(jì)損失獲得賠償,偵查機(jī)關(guān)實(shí)施查封、扣押、凍結(jié)的范圍存在擴(kuò)大化傾向;偵查機(jī)關(guān)查封、扣押、凍結(jié)的涉案財(cái)產(chǎn),人民檢察院、人民法院無權(quán)直接解除;法院判決書中遺漏、概括沒收的現(xiàn)象較為普遍;法院在作出判決時(shí),將刑事沒收轉(zhuǎn)化為罰金刑,以規(guī)避其查證職責(zé),并擴(kuò)大了對涉案財(cái)產(chǎn)的剝奪范圍。為解決上述問題,應(yīng)在立法上對相關(guān)措施的對象范圍、證據(jù)條件、舉證責(zé)任、程序救濟(jì)等作出具體規(guī)定。
[Abstract]:There are outstanding problems in the judicial practice of the disposal of property involved in criminal cases in our country: in order to ensure the victims' economic losses to be compensated, the investigative organs implement the seizure, seizure, and freezing of the scope of the tendency to expand; The people's procuratorate or the people's court shall not have the right to release directly the property seized, seized or frozen by the investigative organ; The phenomenon of general confiscation is common because of omission in the judgment of the court; When the court makes the judgment, it transforms the criminal confiscation into the fine penalty, in order to avoid its checking duty, and expands the scope of the deprivation of the property involved in the case. In order to solve the above problem, the target scope of the relevant measures should be legislated. Conditions of evidence, burden of proof, procedural relief and other specific provisions.
