【摘要】：我國把違法行為分成了一般違法行為和犯罪行為。一般違法行為達(dá)到一定嚴(yán)重程度會(huì)被評價(jià)為犯罪,此時(shí)需要進(jìn)入刑事司法程序進(jìn)行懲處,因此,各類行政機(jī)關(guān)在行政執(zhí)法過程中必然會(huì)面臨行政執(zhí)法證據(jù)準(zhǔn)入的問題。而修正后的《刑事訴訟法》增加第五十二條第二款規(guī)定了:“行政機(jī)關(guān)在行政執(zhí)法和查辦案件中收集的物證、書證、視聽資料、電子數(shù)據(jù)等證據(jù)材料,在刑事訴訟中可以作為證據(jù)使用”。本文針對我國刑事訴訟法關(guān)于行政證據(jù)進(jìn)入刑事訴訟程序的規(guī)定進(jìn)行法律分析,提出了兩個(gè)問題。一是《中華人民共和國刑事訴訟法》(以下簡稱“《刑事訴訟法》”,2012年3月14日公布,2013年1月1日起施行)第52條第2款中的證據(jù)范圍。二是“可以作為證據(jù)使用”具體含義。這都是適用新刑訴法第52條第2款需要研究的問題。首先對比了行政執(zhí)法證據(jù)與刑訴證據(jù)的區(qū)別,主要包括收集主體不同、取證程序不同、證明標(biāo)準(zhǔn)不同。其次,研究了物證、書證、視聽資料、電子數(shù)據(jù)等證據(jù)材料”的范圍,把此范圍分為物證、書證、視聽資料、電子數(shù)據(jù);鑒定意見、勘驗(yàn)、檢查筆錄、檢驗(yàn)報(bào)告;言詞證據(jù)三組。最后,探究了“可以作為證據(jù)使用”的含義。從“可以”的含義,到“證據(jù)”的含義,在到“使用”的含義,把證據(jù)材料分為了作為定案根據(jù)使用、經(jīng)補(bǔ)正或合理解釋后作為定案根據(jù)使用以及作為證據(jù)線索使用三組形式。本文通過研究證據(jù)的范圍和分析該規(guī)定的準(zhǔn)確含義,來明確行政執(zhí)法證據(jù)的準(zhǔn)入。
[Abstract]:Our country divides the illegal behavior into the general illegal act and the criminal behavior. The general illegal behavior can be evaluated as a crime to a certain degree, and it needs to be punished by the criminal justice procedure at this time. In the course of administrative law enforcement, all kinds of administrative organs are bound to face the problem of access to administrative law enforcement evidence. Article 52th, paragraph 2, of the amended Criminal procedure Law stipulates: " Material evidence collected by administrative organs in the course of administrative law enforcement and investigation and handling of cases. Documentary evidence, audio-visual materials, electronic data and other evidence materials can be used as evidence in criminal proceedings. Two questions were raised. First, the Criminal procedure Law of the people's Republic of China (hereinafter referred to as "Criminal procedure Law"), published on March 14th 2012. Effective January 1st 2013). This is the application of the new Criminal procedure Law Article 52 paragraph 2 need to be studied. First of all, the contrast between administrative law enforcement evidence and criminal prosecution evidence. Mainly including the collection of different subjects, different procedures for obtaining evidence, different standards of proof. Secondly, the study of physical evidence, documentary evidence, audio-visual materials, electronic data and other evidence "scope, this scope is divided into physical evidence, documentary evidence." Audiovisual materials, electronic data; Appraisal opinion, investigation, inspection record, inspection report; Finally, it explores the meaning of "can be used as evidence". From the meaning of "can" to "evidence" meaning, in the meaning of "use". The evidentiary materials were divided into the basis of the decision and the use of the evidence. This paper studies the scope of evidence and analyzes the exact meaning of this provision to clarify the admission of administrative law enforcement evidence.
