網(wǎng)絡(luò)購物中的經(jīng)營者權(quán)益維護(hù)研究

【摘要】:網(wǎng)絡(luò)購物已經(jīng)成為了現(xiàn)代人生活之中不可或缺的重要部分。在網(wǎng)絡(luò)購物市場飛速發(fā)展的背后,不難發(fā)現(xiàn)消費(fèi)者和經(jīng)營者的身份已經(jīng)發(fā)生了微妙的變化。越來越多的人看到了網(wǎng)絡(luò)購物市場的巨大潛力,享受著網(wǎng)絡(luò)購物便捷的同時開設(shè)了屬于自己的網(wǎng)絡(luò)商店,進(jìn)行經(jīng)營活動。我國的網(wǎng)民基數(shù)龐大,參與網(wǎng)絡(luò)經(jīng)營活動的人群更是不可小視。正因?yàn)榫W(wǎng)絡(luò)購物活動的參與者不斷增加,由此引發(fā)的買賣糾紛成為了社會輿論關(guān)注的熱點(diǎn)話題,特別是消費(fèi)者權(quán)益的維護(hù),更成為了近年來民商法學(xué)界關(guān)注的焦點(diǎn)。但是,隨著網(wǎng)絡(luò)購物消費(fèi)者權(quán)益維護(hù)呼聲的不斷增加,經(jīng)營者的地位近年來已經(jīng)達(dá)到了低谷。通過網(wǎng)絡(luò)購物對經(jīng)營者進(jìn)行詐騙以及惡意投訴的情況時常發(fā)生,網(wǎng)絡(luò)平臺的消費(fèi)者本位現(xiàn)象都讓經(jīng)營者維權(quán)的難度直線上升。我國現(xiàn)行法律在對網(wǎng)絡(luò)交易模式進(jìn)行法規(guī)方面,依然在沿用規(guī)范傳統(tǒng)購物模式的相關(guān)法律法規(guī),特別是針對經(jīng)營者的權(quán)益維護(hù)的內(nèi)容更接近于空白。本文進(jìn)行研究的過程中,采用理論與實(shí)踐相結(jié)合的論證方式,論述在網(wǎng)絡(luò)模式下對經(jīng)營權(quán)益保護(hù)的必要性,并且提出相關(guān)的完善措施。 文章總共分為四章,第一章中筆者將主要說明目前網(wǎng)絡(luò)消費(fèi)的集中主要類型,其中以消費(fèi)者參與人數(shù)最多的B2C和C2C這兩種模式作為重點(diǎn),從經(jīng)營形式和經(jīng)營者特點(diǎn)兩方面進(jìn)行詳細(xì)介紹。在第一章的后半部分對網(wǎng)絡(luò)購物的合同形式與傳統(tǒng)消費(fèi)活動中的合同形式進(jìn)行說明,結(jié)合目前的立法情況分析整個合同履行的過程以及合同的效力。 第二章主要通過事例列舉出一系列消費(fèi)者侵犯經(jīng)營者權(quán)益的事例,說明目前網(wǎng)絡(luò)購物的輿論發(fā)展傾向于“消費(fèi)者本位”,經(jīng)營者維權(quán)困難。通過明確地分類,總結(jié)經(jīng)營者被侵權(quán)行為的種類,為后文提出解決辦法做出鋪墊。 第三章中,筆者結(jié)合社會發(fā)展以及我國交易保護(hù)機(jī)制辦法,對經(jīng)營者維權(quán)困難、維權(quán)過程中暴露出來的消費(fèi)者本位現(xiàn)象的成因進(jìn)行分析。分別以消費(fèi)者、第三方網(wǎng)絡(luò)平臺和社會輿論作為切入點(diǎn),系統(tǒng)全面地剖析經(jīng)營者法律地位缺失的原因。 在全文的第四章,筆者將結(jié)合西方先進(jìn)國家關(guān)于網(wǎng)絡(luò)購物內(nèi)容的立法舉措,,對我國目前用來規(guī)范網(wǎng)絡(luò)購物的相關(guān)法律進(jìn)行分析,指出我國目前關(guān)于經(jīng)營者維權(quán)相關(guān)內(nèi)容的立法缺陷。而且在本部分的最后,筆者結(jié)合互聯(lián)網(wǎng)本身的特性,對如何更好地維護(hù)經(jīng)營者權(quán)益進(jìn)行改進(jìn)建議。
[Abstract]:Network shopping has become an indispensable part of modern life. Behind the rapid development of the network shopping market, it is not difficult to find a subtle change in the identity of consumers and operators. An increasing number of people have seen the huge potential of the network shopping market, enjoying the convenience of the network, and opening up their own network shops and doing business activities. China's Internet users have a large base, and the people involved in the network management activities are not as small as possible. Because of the increasing number of participants in the network shopping, the sale of the disputes has become a topic of concern to the public opinion, especially the maintenance of the consumer's rights and interests, and has become the focus of the attention of the people's commercial law circles in recent years. However, as the voice of the network shopping consumer's rights and interests is increasing, the position of the operator has reached the trough in recent years. Through the network shopping for the operators to cheat and the case of malicious complaints, the consumer-based phenomenon of the network platform has allowed the operator to make a straight rise in the difficulty of protecting the rights of the operators. The existing laws of our country still use the relevant laws and regulations to regulate the traditional shopping mode, especially the content of the operator's rights and interests, which is more close to the blank in terms of the regulation of the network transaction model. In the course of the research, this paper discusses the necessity of protecting the rights and interests in the network mode with the combination of theory and practice, and puts forward some related measures. The article is divided into four chapters. In the first chapter, the author will mainly describe the main types of the current network consumption, in which the two modes of B2C and C2C with the largest number of consumers' participation are the key points, and from the operating mode and the operator's characteristics, the author In the second half of the first chapter, the contract form of the network shopping and the contract form in the traditional consumption activity are explained, and the process of the whole contract performance and the effect of the contract are analyzed in the light of the current legislative situation In the second chapter, a series of examples of consumers' rights and interests are listed in the second chapter, which shows that the development of public opinion in the current network tends to be the "consumer standard" and the operator's dimension. The right is difficult. By clearly classifying, the category of the operator's tort is summarized, and the solution will be put forward later. In the third chapter, the author combined with the social development and the method of our country's transaction protection mechanism, to the operator's rights to protect the rights, the exposed consumer-based phenomenon in the process of safeguarding the rights The analysis takes the consumer, the third party network platform and the public opinion as the entry point, and the system fully analyzes the legal status of the operator In the fourth chapter of the full text, the author will combine with the legislation of the western advanced countries about the content of network shopping, and analyze the relevant laws which are currently used to regulate the network shopping in our country, and point out that our country is related to the operator's rights protection. In the end of this part, the author combines the characteristics of the Internet and how to better maintain the right of the operator.
