房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)法律制度研究

【摘要】: 房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)是美國(guó)等國(guó)家廣泛適用的用于保障交易安全的一個(gè)重要保險(xiǎn)品種,產(chǎn)權(quán)報(bào)告是該制度的關(guān)鍵。房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)一般由保險(xiǎn)公司專(zhuān)員在調(diào)查房地產(chǎn)權(quán)狀況后編纂而成,保險(xiǎn)公司承諾如果房地產(chǎn)產(chǎn)權(quán)存在產(chǎn)權(quán)報(bào)告中應(yīng)記載而沒(méi)有記載的瑕疵和糾紛,保險(xiǎn)人負(fù)責(zé)消除產(chǎn)權(quán)瑕疵,或在保險(xiǎn)金額范圍內(nèi)對(duì)被保險(xiǎn)人的損失進(jìn)行賠償。這一保險(xiǎn)制度對(duì)減免房地產(chǎn)產(chǎn)權(quán)登記機(jī)關(guān)的負(fù)擔(dān)、提升交易安全和效率、促進(jìn)保險(xiǎn)業(yè)的發(fā)展均有重要意義,值得我國(guó)借鑒和選擇性移植。但我國(guó)與美國(guó)的登記制度等存在差異,制度的引進(jìn)和重新構(gòu)建需考慮諸多條件因素。 本文分為五個(gè)部分。 第一部分介紹房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的內(nèi)涵。該部分對(duì)產(chǎn)權(quán)、房地產(chǎn)產(chǎn)權(quán)做出了明確界定,闡明了房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的對(duì)象。通過(guò)與普通人壽險(xiǎn)和財(cái)產(chǎn)險(xiǎn)的比較,凸出房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)在保險(xiǎn)標(biāo)的、范圍、期間、保險(xiǎn)費(fèi)、保險(xiǎn)責(zé)任等方面的特殊性。之后簡(jiǎn)述了房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的運(yùn)作方式。 第二部分從理論上對(duì)房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)進(jìn)行了分析。首先是從經(jīng)濟(jì)學(xué)角度分析,表明保險(xiǎn)在化解風(fēng)險(xiǎn)方面的價(jià)值,隨后從民商法、經(jīng)濟(jì)法、社會(huì)法的角度,分析房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的法律性質(zhì),闡明其對(duì)促進(jìn)民法上的交易便捷、社會(huì)法追求的社會(huì)整體福利,并論述了以經(jīng)濟(jì)法對(duì)房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)進(jìn)行規(guī)制的理論基礎(chǔ)。 第三部分介紹了產(chǎn)權(quán)保險(xiǎn)在美國(guó)產(chǎn)生的背景和原因,以期找到與當(dāng)今中國(guó)環(huán)境的共同點(diǎn)。之后分析了美國(guó)產(chǎn)權(quán)保險(xiǎn)制度對(duì)于中國(guó)的價(jià)值,得出需因地制宜構(gòu)建中國(guó)的房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的結(jié)論。 第四部分分析了我國(guó)房地產(chǎn)交易中存在的多方面風(fēng)險(xiǎn)以及房地產(chǎn)保險(xiǎn)業(yè)的現(xiàn)狀與不足,著重分析現(xiàn)有房產(chǎn)交易中公證程序、律師見(jiàn)證程序?qū)ΡU辖灰装踩牟蛔。此?該部分分析了我國(guó)登記程序存在的不足,房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)可以成為登記制度改革的保障措施。之后,該部分點(diǎn)出了房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)制度在我國(guó)面臨的障礙。 第五部分試圖構(gòu)建我國(guó)的房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)制度。首先從立法角度,提出了立法模式的選擇,提出制定《房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)試行條例》的構(gòu)想,構(gòu)建了條例的指導(dǎo)原則、房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的品種,闡明了房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的基本構(gòu)成要素,以及對(duì)房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的監(jiān)管建議。之后提出了房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)的相關(guān)配套措施,主要從登記性質(zhì)的轉(zhuǎn)換、產(chǎn)權(quán)信息庫(kù)的構(gòu)建作出說(shuō)明。最后提出了房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)在現(xiàn)階段試推行的折中方案。 本文綜合運(yùn)用了比較法學(xué)、經(jīng)濟(jì)學(xué)、社會(huì)學(xué)等研究方法,對(duì)房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)制度進(jìn)行了研究,該選題價(jià)值在于通過(guò)構(gòu)建我國(guó)的房地產(chǎn)產(chǎn)權(quán)保險(xiǎn)制度,重新界定房地產(chǎn)產(chǎn)權(quán)登記機(jī)關(guān)權(quán)責(zé),以期達(dá)到改變現(xiàn)有登記制度或彌補(bǔ)其不足,以及促進(jìn)房地產(chǎn)交易安全的效果。
[Abstract]:Real estate property right insurance is an important insurance variety widely used to ensure transaction security in the United States and other countries, and property right report is the key to the system. The real estate property right insurance is generally compiled by the commissioner of the insurance company after investigating the property right of the real estate. The insurance company promises that if the real estate property right has defects and disputes that should be recorded in the property right report but not recorded in the property right report, The insurer is responsible for eliminating the defects of property rights or compensation for the losses of the insured within the insured amount. This insurance system is of great significance to reduce the burden of real estate property rights registration authorities, improve transaction security and efficiency, and promote the development of insurance industry, which is worthy of reference and selective transplantation in our country. However, there are differences in the registration system between China and the United States, and the introduction and reconstruction of the system need to consider many conditional factors. This paper is divided into five parts. The first part introduces the connotation of real estate property right insurance. This part makes a clear definition of property rights and real estate property rights, and clarifies the object of real estate property rights insurance. By comparing with ordinary people's life insurance and property insurance, this paper highlights the particularity of real estate property right insurance in the aspects of subject matter, scope, period, insurance premium, insurance liability and so on. Then it briefly describes the operation mode of real estate property right insurance. The second part theoretically analyzes the real estate property right insurance. First of all, from the economic point of view, it shows the value of insurance in resolving risks, and then from the perspective of civil and commercial law, economic law, social law, analyzes the legal nature of real estate property rights insurance, and clarifies its convenience in promoting the transaction in civil law. The social welfare pursued by social law, and discusses the theoretical basis of regulating real estate property right insurance by economic law. The third part introduces the background and reasons of property right insurance in the United States, in order to find the common ground with today's Chinese environment. Then it analyzes the value of the American property right insurance system to China, and draws the conclusion that it is necessary to construct the real estate property right insurance in China according to the local conditions. The fourth part analyzes the risks existing in the real estate transaction in our country and the present situation and shortcomings of the real estate insurance industry, focusing on the lack of notarization procedure and lawyer witness procedure in the existing real estate transaction to ensure the security of the transaction. In addition, this part analyzes the shortcomings of the registration procedure in our country, and the real estate property right insurance can become the safeguard measure of the registration system reform. After that, this part points out the obstacles faced by the real estate property right insurance system in our country. The fifth part tries to construct the real estate property right insurance system of our country. First of all, from the legislative point of view, this paper puts forward the choice of legislative mode, puts forward the idea of formulating the trial regulations of Real Estate property Rights Insurance, and constructs the guiding principles of the regulations and the varieties of real estate property rights insurance. This paper expounds the basic elements of real estate property right insurance and the supervision suggestions of real estate property right insurance. Then it puts forward the relevant supporting measures of real estate property right insurance, mainly from the transformation of registration nature and the construction of property right information base. Finally, the paper puts forward the compromise scheme of real estate property right insurance at this stage. This paper makes a comprehensive use of comparative law, economics, sociology and other research methods to study the real estate property right insurance system. The value of this topic lies in the construction of the real estate property right insurance system in our country. In order to change the existing registration system or make up for its shortcomings, and to promote the safety of real estate transactions, the power and responsibility of real estate property rights registration authority can be redefined in order to achieve the effect of changing the existing registration system or making up for its shortcomings.
