【摘要】：針對法律實踐中港口經(jīng)營人的抗辯和責(zé)任限制運用的混亂,我們急于解決港口經(jīng)營人的責(zé)任限制問題,基于對其理論基礎(chǔ)的探索,討論港口經(jīng)營人法律地位這一世界范圍內(nèi)廣泛存在的問題�！堵固氐ひ�(guī)則》針對承運人履行輔助人規(guī)定了海運履約方制度,本文對《鹿特丹規(guī)則》影響下的港口經(jīng)營人進行分析,說明合理性,并對我國《海商法》港口經(jīng)營人制度完善提出自己建議。本文第一章分析了港口經(jīng)營人在我國的現(xiàn)狀,包括法律地位學(xué)說的爭議和立法現(xiàn)狀。指出法律地位的三種學(xué)說的不妥之處和法律實踐中責(zé)任限制運用的混亂。第二章通過分析海運履約方制度對港口經(jīng)營人的地位、義務(wù)和責(zé)任的影響,闡述了其合理性,得出海運履約方制度能幫助摒棄一些不適當(dāng)?shù)母劭诮?jīng)營人地位學(xué)說并能夠?qū)Ω劭诮?jīng)營人法律地位及責(zé)任的確定產(chǎn)生輔助作用的結(jié)論。最后一章提出自己完善港口經(jīng)營人制度的建議。建議引進海運履約方制度,并相銜國際海運規(guī)則的同時充分結(jié)合我國實際情況作出修改,對不能歸納于海運履約方范疇的建議補充規(guī)定。
[Abstract]:In view of the confusion of the defense and limitation of liability of port operators in legal practice, we are eager to solve the problem of limitation of liability of port operators, based on the exploration of its theoretical basis. This paper discusses the legal status of port operators, which is a widespread problem in the world. The Rotterdam rules provide for the maritime performing party system for the carrier's performance assistant. This paper analyzes the port operators under the influence of the Rotterdam rules, explains the rationality, and puts forward some suggestions on the improvement of the port operator system of the Maritime Law of our country. The first chapter of this paper analyzes the present situation of port operators in our country, including the dispute of legal status theory and the present situation of legislation. This paper points out the inappropriateness of the three theories of legal status and the confusion of the application of liability restriction in legal practice. The second chapter expounds its rationality by analyzing the influence of the maritime performing party system on the status, obligations and responsibilities of the port operator. It is concluded that the maritime performing party system can help to abandon some inappropriate theories of port operator status and can play an auxiliary role in determining the legal status and liability of port operators. The last chapter puts forward some suggestions to improve the port operator system. It is suggested that the maritime performing party system should be introduced, and the rules of international maritime transport should be fully modified in the light of the actual situation of our country, and the supplementary provisions should not be summarized into the category of maritime performing party.
