【摘要】：票據(jù)具有簡(jiǎn)化市場(chǎng)經(jīng)濟(jì)活動(dòng)的重要價(jià)值,票據(jù)保證制度正是為追加票據(jù)信用而設(shè)立,其目的是為了加強(qiáng)票據(jù)付款的確定性,從而促進(jìn)票據(jù)安全快捷的流通。本文從票據(jù)保證制度的概述入手,分四部分對(duì)票據(jù)保證制度進(jìn)行了闡述。 第一部分為票據(jù)保證制度的概述。本部分主要介紹了票據(jù)保證的概念、特征和各國(guó)立法例,票據(jù)保證的四種類(lèi)型,以及與民事保證的比較分析。 第二部分為票據(jù)保證的構(gòu)成要件。本部分對(duì)保證人、被保證人、絕對(duì)必要記載事項(xiàng)、相對(duì)必要記載事項(xiàng)和記載無(wú)效的事項(xiàng)分別進(jìn)行了闡述。 第三部分為票據(jù)保證人的權(quán)利和責(zé)任。票據(jù)保證人的權(quán)利主要包括抗辯權(quán)和代位權(quán);票據(jù)保證人的責(zé)任則具有同一性、獨(dú)立性和連帶性的基本特征。 第四部分為票據(jù)保證若干實(shí)務(wù)問(wèn)題及其思考。本部分主要討論了隱存保證背書(shū)問(wèn)題和支票保付問(wèn)題,并就上述問(wèn)題提出了觀(guān)點(diǎn)和建議。
[Abstract]:Bill has the important value of simplifying the activity of market economy. The guarantee system of bill is set up for the purpose of strengthening the certainty of bill payment and promoting the safe and fast circulation of bill. Starting with the overview of bill guarantee system, this paper expounds the bill guarantee system in four parts. The first part is an overview of the bill guarantee system. This part mainly introduces the concept and characteristics of bill guarantee, the legislative examples of various countries, the four types of bill guarantee, and the comparative analysis with civil guarantee. The second part is the constituent elements of bill guarantee. This part expounds the guarantor, the absolutely necessary record, the relative necessary record and the invalid record respectively. The third part is the rights and responsibilities of the guarantor of the instrument. The rights of the guarantor of the bill mainly include the right of defense and the right of subrogation, while the responsibility of the guarantor of the bill has the basic characteristics of identity, independence and concatenation. The fourth part is about some practical problems and thinking of bill guarantee. This part mainly discusses the problem of implicit guarantee endorsement and check guarantee payment, and puts forward some views and suggestions on the above problems.
