對(duì)實(shí)際承運(yùn)人責(zé)任制度的探討

【摘要】: 我國(guó)《海商法》在制定的過程中借鑒了《漢堡規(guī)則》的做法,界定了實(shí)際承運(yùn)人概念,確立了實(shí)際承運(yùn)人制度,對(duì)一些相關(guān)的法律關(guān)系問題作了相應(yīng)的規(guī)定,解決了未參與海上貨物運(yùn)輸合同的訂立但參與貨物運(yùn)輸?shù)膶?shí)際運(yùn)輸者的權(quán)利、義務(wù)和責(zé)任問題,加大了對(duì)貨方利益的保護(hù)。但該理論存在著一定缺陷和漏洞,對(duì)一些法律問題的規(guī)定不太明確,例如:實(shí)際承運(yùn)人責(zé)任的性質(zhì)、實(shí)際承運(yùn)人的歸責(zé)原則、實(shí)際承運(yùn)人的責(zé)任范圍。立法的不成熟給司法實(shí)踐帶來了一定的困惑,理論上對(duì)實(shí)際承運(yùn)人制度的研究也有待于進(jìn)一步深化。本文試圖對(duì)實(shí)際承運(yùn)人制度中的部分問題進(jìn)行探究。 第一章旨在對(duì)實(shí)際承運(yùn)人制度中的部分概念進(jìn)行剖析,其中涉及到"entrust"、實(shí)際履行貨物運(yùn)輸、"責(zé)任"這些重要概念的界定。 第二章論述了實(shí)際承運(yùn)人責(zé)任與承運(yùn)人責(zé)任的關(guān)系,試圖用不真正連帶責(zé)任關(guān)系理論對(duì)這一問題進(jìn)行分析。 第三章闡述了實(shí)際承運(yùn)人責(zé)任制度中的不足之處及其完善的途徑,其中涉及了實(shí)際承運(yùn)人責(zé)任的性質(zhì)、實(shí)際承運(yùn)人的規(guī)則原則、實(shí)際承運(yùn)人責(zé)任的范圍等問題。 第四章分析了研究實(shí)際承運(yùn)人責(zé)任制度的價(jià)值,主要從實(shí)際承運(yùn)人責(zé)任制度的法律價(jià)值和實(shí)踐價(jià)值兩個(gè)方面來分析。 筆者試圖通過本文的論述,探究實(shí)際承運(yùn)人責(zé)任制度中的部分不足之處及其對(duì)策,以求在理論和立法上對(duì)該制度進(jìn)行完善。
[Abstract]:In the process of formulating the Maritime Law of our country, it draws lessons from the practice of the Hamburg rules, defines the concept of the actual carrier, establishes the actual carrier system, and makes corresponding provisions on some related legal relationship issues. It solves the problems of the rights, obligations and responsibilities of the actual transporters who do not participate in the conclusion of the contract for the carriage of goods by sea but participate in the carriage of goods, and increases the protection of the interests of the consignors. However, there are some defects and loopholes in the theory, and the provisions on some legal issues are not very clear, such as the nature of the actual carrier's liability, the imputation principle of the actual carrier, and the scope of the actual carrier's liability. The immaturity of legislation has brought some confusion to judicial practice, and the theoretical research on the actual carrier system needs to be further deepened. This paper attempts to explore some problems in the actual carrier system. The first chapter aims to analyze some concepts in the actual carrier system, including the definition of "entrust", the actual performance of the carriage of goods and the definition of "liability". The second chapter discusses the relationship between the actual carrier liability and the carrier liability, and tries to analyze this problem with the theory of unreal joint and several liability relationship. The third chapter expounds the shortcomings of the actual carrier liability system and the ways to improve it, including the nature of the actual carrier liability, the rules and principles of the actual carrier, the scope of the actual carrier liability and so on. The fourth chapter analyzes the value of the actual carrier liability system, mainly from the legal value and practical value of the actual carrier liability system. Through the discussion of this paper, the author tries to explore some shortcomings and countermeasures in the actual carrier liability system, in order to perfect the system in theory and legislation.
