《鹿特丹規(guī)則》之下托運(yùn)人制度研究
[Abstract]:At its 67th meeting, on 11 December 2008, the General Assembly of the United Nations formally adopted the United Nations Convention on the International Carriage of goods wholly or partly by Sea and held a signing ceremony in Rotterdam, the Netherlands, on 23 September 2009, Name the Convention the Rotterdam rules. This new convention has made many major changes to the shipper's system. The three previous international maritime conventions that have entered into force can be said to be carrier-centered, focusing on the obligations and responsibilities of the carrier. The Rotterdam rules change the situation in which shippers are not attached importance to in previous international conventions. Great enthusiasm and energy have been invested in the shipper. The Rotterdam rules redefine the shipper, introduce the documentary shipper, and specify the rights and obligations of the shipper in detail. Starting from the shipper, this paper compares the differences between the Rotterdam rules and the previous three conventions, analyzes the advantages and disadvantages of the shipper system in the Rotterdam rules, and finally combines the practice of shipping in China. Some suggestions on the amendment of Maritime Law are put forward. The full text is divided into three parts: introduction, main body and conclusion.
