【摘要】：無論從設(shè)立中公司的特征、性質(zhì),還是從商法的基本原則看,均應(yīng)將公司的權(quán)利能力前置,賦予設(shè)立中公司一定的權(quán)利能力。但設(shè)立中公司的權(quán)利能力應(yīng)受到一定限制。
[Abstract]:Whether from the characteristics and nature of the company in the process of establishment, or from the basic principles of commercial law, the right ability of the company should be preempted and given to the company in the process of establishment. However, the right and ability of the company under establishment should be limited to a certain extent.
