論海上貨物運(yùn)輸中交付阻卻法律問(wèn)題

【摘要】: 在海上貨物運(yùn)輸過(guò)程中,貨物在目的港的交付是整個(gè)航程的最后一個(gè)環(huán)節(jié),也是承運(yùn)人貨物運(yùn)輸任務(wù)終結(jié)的標(biāo)志。但是,由于買(mǎi)賣(mài)雙方在國(guó)際貿(mào)易上的問(wèn)題等原因,當(dāng)貨抵目的港時(shí)無(wú)人提貨或者拒絕提貨,導(dǎo)致承運(yùn)人交付義務(wù)的履行受到阻卻,并因此給承運(yùn)人帶來(lái)到付運(yùn)費(fèi)、集裝箱超期使用費(fèi)、碼頭的堆存費(fèi)等無(wú)法控制的經(jīng)濟(jì)損失。在這種狀況下,實(shí)際上往往是貨方將其在國(guó)際貨物買(mǎi)賣(mài)中的風(fēng)險(xiǎn)轉(zhuǎn)嫁給承運(yùn)人,使承運(yùn)人的合法權(quán)益受到損害,對(duì)于承運(yùn)人來(lái)說(shuō)顯失公平,在一定意義上也造成了社會(huì)財(cái)富的浪費(fèi)。通過(guò)本論題的研究,希望能為立法機(jī)關(guān)完善我國(guó)《海商法》關(guān)于目的港貨物交付阻卻問(wèn)題的解決提供一種思路,以切實(shí)維護(hù)承運(yùn)人的合法權(quán)益。 本文以維護(hù)承運(yùn)人在貨物交付阻卻情況下的合法權(quán)益為主旨,全文除了引言和結(jié)束語(yǔ)外,共分為四章: 第一章從引入目的港貨物交付阻卻的概念入手,介紹及分析目的港貨物交付阻卻的現(xiàn)狀、成因,以及承運(yùn)人交付義務(wù)的特殊性和目的港貨物交付阻卻的法律后果,闡明承運(yùn)人是目的港貨物交付阻卻的受害者,應(yīng)作為權(quán)利主體向貨方要求損害賠償。 第二章通過(guò)對(duì)于目的港貨物交付阻卻責(zé)任屬性和責(zé)任主體的認(rèn)定,論述締約托運(yùn)人應(yīng)作為目的港貨物交付阻卻的責(zé)任主體,承擔(dān)承運(yùn)人因交付義務(wù)受阻遭受的經(jīng)濟(jì)損失的賠償責(zé)任。 第三章從提存、海上貨物的留置、司法救濟(jì)、行政措施對(duì)解決目的港貨物交付阻卻的影響四個(gè)方面,闡述如何對(duì)承運(yùn)人的合法權(quán)益予以救濟(jì)。 第四章針對(duì)司法實(shí)踐中存在的局限,提出完善解決目的港貨物交付阻卻問(wèn)題的立法建議。
[Abstract]:The delivery of goods in the port of destination is the last link of the whole voyage during the carriage of goods by sea, and it is also the symbol of the end of the carrier's cargo transport task. However, due to the problems in international trade between the buyer and the seller, when the goods arrived at the port of destination, no one picked up the goods or refused to take the goods, which prevented the carrier from performing the obligation to deliver, and thus brought the carrier to pay the freight. Beyond the control of container usage fees, terminal storage fees and other economic losses. In such a situation, it is often the cargo party that passes on its risks in the international sale of goods to the carrier, thereby harming the carrier's legitimate rights and interests, which is manifestly unfair to the carrier. In a certain sense also caused the waste of social wealth. Through the research of this thesis, the author hopes to provide a way of thinking for the legislature to solve the problem of goods delivery resistance in the port of destination, so as to protect the legitimate rights and interests of the carrier. In order to protect the carrier's legitimate rights and interests in the case of goods delivery resistance, this paper is divided into four chapters except the introduction and conclusion: the first chapter begins with the introduction of the concept of cargo delivery resistance in the port of destination. This paper introduces and analyzes the present situation and causes of the goods delivery resistance in the port of destination, as well as the particularity of the carrier's obligation to deliver and the legal consequences of the goods delivery resistance in the port of destination, and clarifies that the carrier is the victim of the goods delivery resistance at the destination port. Claims for damages shall be made to the shipper as the subject of the right. The second chapter discusses that the contracting shipper should be the subject of liability for the delivery of the goods at the port of destination through the identification of the attribute of the liability and the subject of the responsibility for the delivery of the goods at the port of destination. The carrier shall be liable for any economic loss suffered by the carrier due to the obstruction of the obligation of delivery. The third chapter expounds how to remedy the carrier's legitimate rights and interests from four aspects: deposit of goods on the sea, judicial relief, and the influence of administrative measures on solving the obstruction of delivery of goods in the port of destination. In the fourth chapter, in view of the limitation of judicial practice, the author puts forward some legislative suggestions to solve the problem of goods delivery obstruction in port of destination.
