【摘要】：取得時(shí)效制度產(chǎn)生于古羅馬法時(shí)的十二銅表法,大多數(shù)資本主義國(guó) 家在立法中均采用了此項(xiàng)制度,我國(guó)由于受蘇俄民法典的影響,一直認(rèn) 為取得時(shí)效與社會(huì)主義制度相悖,而予以否定。九十年代以來(lái),我國(guó)推 行了社會(huì)主義市場(chǎng)經(jīng)濟(jì)制度后,建立與社會(huì)主義市場(chǎng)經(jīng)濟(jì)相適應(yīng)的完善 的民商法制度的必要性與緊迫性與日俱增、勢(shì)在必行,特別是國(guó)家立法 機(jī)關(guān)提出制定物權(quán)法后,建立我國(guó)的取得時(shí)效制度成為學(xué)者之共識(shí)。本 文試圖通過(guò)對(duì)各國(guó)取得時(shí)效制度及我國(guó)現(xiàn)狀的分析,進(jìn)而對(duì)我國(guó)取得時(shí) 效制度進(jìn)行立法思考,諸如:各國(guó)的取得時(shí)效制度研究、借鑒,我國(guó)建 立此項(xiàng)制度的必要性及具體制度的設(shè)計(jì),以期對(duì)我國(guó)取得時(shí)效制度的建 立有所裨益。
[Abstract]:The acquisitive prescription system came into being in ancient Roman law, which was adopted by most capitalist countries in their legislation. Because of the influence of the Soviet Civil Code, most capitalist countries adopted this system in their legislation. It has always been recognized that the prescription of acquisition contradicts the socialist system and denies it. Since the 1990s, after the introduction of the socialist market economy system, The necessity and urgency of establishing a perfect civil and commercial law system adapted to the socialist market economy is increasing day by day, and it is imperative, especially after the enactment of the property law by the state legislature, It has become the consensus of scholars to establish the acquisitive prescription system in our country. Through the analysis of the acquisitive prescription system and the present situation of our country, this paper tries to legislate the acquisitive time-effect system of our country, such as: the research of the acquisitive prescription system in various countries. For reference, the necessity of establishing this system and the design of concrete system in our country are expected to benefit the establishment of the prescription system in our country.
