【摘要】：連帶責(zé)任制度作為民商法領(lǐng)域的一項(xiàng)重要制度,在我國民商法的很多領(lǐng)域都有相關(guān)規(guī)定,但理論界對(duì)連帶責(zé)任的研究尚未深入,本文主要就連帶責(zé)任的概念及構(gòu)成要件、設(shè)立連帶責(zé)任制度的立法用意、民商法中關(guān)于連帶責(zé)任的規(guī)定、承擔(dān)連帶責(zé)任后的追償?shù)确矫孢M(jìn)行簡(jiǎn)要的分析。
[Abstract]:As an important system in the field of civil and commercial law, the system of joint and several liability has relevant provisions in many fields of civil and commercial law of our country. However, the research on joint and several liability has not been thoroughly studied in the theoretical circle. This paper mainly focuses on the concept of joint and several liability and its constitutive requirements. The legislative intention of establishing the system of joint and several liability, the stipulation of joint and several liability in civil and commercial law, and the recovery after assuming joint and several liability are briefly analyzed.
