高?蒲许(xiàng)目吸納畢業(yè)生就業(yè)政策的法律矯正研究

【摘要】:高?蒲许(xiàng)目吸納大學(xué)畢業(yè)生就業(yè)是我國(guó)政府在金融危機(jī)背景下推出的就業(yè)促進(jìn)政策。在以個(gè)體為本位的民商法領(lǐng)域有雇傭(勞務(wù))合同規(guī)定,在以社會(huì)為本位的勞動(dòng)法領(lǐng)域有勞動(dòng)合同的規(guī)定。但是該政策規(guī)定不能被上述法律完全包容,其與法律的矛盾顯而易見(jiàn)。為避免這一新生事物流于應(yīng)景之策或權(quán)宜之計(jì),有必要用法律匡正偏倚的高?蒲许(xiàng)目吸納大學(xué)畢業(yè)生就業(yè)政策,以法律的穩(wěn)定性和妥當(dāng)性保證此項(xiàng)政策的統(tǒng)一性、穩(wěn)定性、長(zhǎng)效性和合法性,使高?蒲许(xiàng)目吸納大學(xué)畢業(yè)生就業(yè)成為一種歷久可行的用人制度,為就業(yè)協(xié)議雙方當(dāng)事人合法權(quán)益提供有效的法律保障,進(jìn)而推進(jìn)該制度的良好和穩(wěn)步運(yùn)行。 本文以文本研究的方法為主。運(yùn)用比較法,將科研項(xiàng)目吸納畢業(yè)生就業(yè)相關(guān)政策資料進(jìn)行羅列分析,從而準(zhǔn)確地發(fā)現(xiàn)并提出問(wèn)題;運(yùn)用法解釋學(xué)的方法,進(jìn)一步梳理該政策中存在的問(wèn)題及其與法律的關(guān)系,指出解決問(wèn)題的框架性構(gòu)想,即用民法抑或是勞動(dòng)法對(duì)政策進(jìn)行涵攝;運(yùn)用法經(jīng)濟(jì)學(xué)的方法剖析民法體制下和勞動(dòng)法體制下就業(yè)均衡實(shí)現(xiàn)的理想形態(tài);運(yùn)用法社會(huì)學(xué)的方法描摹現(xiàn)實(shí)中的法律實(shí)施狀態(tài),采用實(shí)質(zhì)公平的理念實(shí)現(xiàn)對(duì)用人方和被聘畢業(yè)生之間的利益平衡;最后借鑒立法學(xué)的方法,以社會(huì)的“秩序化需求”為動(dòng)因,在勞動(dòng)法的框架下實(shí)現(xiàn)對(duì)政策本身的改良,以避免工具主義的“功利性”法律觀。 文章分三章,第一章分析了高?蒲许(xiàng)目吸納畢業(yè)生就業(yè)系列政策,指出該政策的創(chuàng)新性和存在的主要問(wèn)題,包括政策內(nèi)部的沖突和與法律之間的沖突;第二章通過(guò)法學(xué)理論的探究,將高?蒲许(xiàng)目吸納大學(xué)畢業(yè)生就業(yè)的法律問(wèn)題劃歸民法和社會(huì)法兩個(gè)領(lǐng)域加以對(duì)比分析,確定以勞動(dòng)法作為政策完善的基點(diǎn);第三章提出了具體的政策建議,包括:科研項(xiàng)目范圍的界定,締約主體的明確,服務(wù)協(xié)議的性質(zhì)的界定,權(quán)利義務(wù)的設(shè)置,解聘途徑與經(jīng)濟(jì)補(bǔ)償?shù)拇_定幾個(gè)方面。從而消彌政策之間的沖突,實(shí)現(xiàn)政策與法律的良性銜接,最終達(dá)到以法律為后盾,以政策為導(dǎo)向,準(zhǔn)確確定畢業(yè)生和高校以及項(xiàng)目組之間的權(quán)利義務(wù)和責(zé)任關(guān)系,實(shí)現(xiàn)政策效果、法律效果和社會(huì)效果的統(tǒng)一。
[Abstract]:It is an employment promotion policy put forward by the government of our country under the background of the financial crisis. There are employment (labor) contracts in the field of individual-oriented civil and commercial law and labor contracts in the field of social-based labor laws. But the policy can not be completely contained by the above-mentioned laws, and its conflict with the law is obvious. In order to prevent this new thing from flowing into the immediate situation or expedient, it is necessary to absorb the employment policy of university graduates by the scientific research projects which are biased by the law, so as to ensure the unity and stability of this policy with the stability and appropriateness of the law. The long-term effect and legitimacy make the employment of university graduates in university scientific research projects become a long-lasting and feasible employment system, and provide effective legal protection for the legal rights and interests of both parties to the employment agreement. And then promote the good and steady operation of the system. This paper focuses on textual research. The comparative method is used to list and analyze the relevant policy data of the employment of scientific research projects, so as to find and raise the problems accurately. By using the method of legal hermeneutics, this paper further combs the problems existing in the policy and its relationship with the law, and points out the frame conception of solving the problem, that is, using civil law or labor law to absorb the policy; Using the method of law and economics to analyze the ideal form of the employment equilibrium under the civil law system and the labor law system; The method of sociology of law is used to describe the state of law implementation in reality and to balance the interests of employers and employed graduates with the concept of substantial fairness. Finally, using the method of legislation for reference, taking the "order demand" of the society as the motivation, we can improve the policy itself under the framework of labor law, so as to avoid the instrumentalism "utilitarian" legal view. This paper is divided into three chapters. The first chapter analyzes the employment policy of university scientific research projects, and points out the innovation and the main problems of the policy, including the conflict between the policy and the law. The second chapter, through the exploration of the theory of law, classifies the legal problems of university scientific research projects into the two fields of civil law and social law, and determines that the labor law is the base point of policy improvement. The third chapter puts forward specific policy recommendations, including: the definition of the scope of scientific research projects, the definition of the contracting body, the nature of the service agreement, the establishment of rights and obligations, the way of dismissal and the determination of economic compensation. In order to eliminate the conflict between the policies, realize the benign link between the policy and the law, and finally reach the goal of taking the law as the backing, taking the policy as the guide, and accurately determining the relationship between the rights, obligations and responsibilities of the graduates, the universities and the project teams, Realize the unity of policy effect, legal effect and social effect.
