【摘要】：跨國商法是一種產(chǎn)生于國際商事市民社會的法律,其根本效力來源于一般化了的商事實踐。這種法律體系是相對獨立于國家主權(quán)立法的,但是它能夠很好地規(guī)范跨國商事交易,因此可以被看成一種嶄新的國際商法淵源。
[Abstract]:Transnational commercial law is a kind of law arising from the international commercial civil society, and its fundamental effect comes from the general commercial practice. This legal system is relatively independent of national sovereignty legislation, but it can well regulate transnational commercial transactions, so it can be regarded as a new source of international commercial law.
