當(dāng)代共同海損制度的評(píng)價(jià)與發(fā)展趨勢(shì)

【摘要】: 本文對(duì)現(xiàn)行的共同海損制度進(jìn)行了評(píng)價(jià)、分析。首先分析研究了當(dāng)前海上運(yùn)輸中各項(xiàng)制度新的發(fā)展對(duì)共同海損制度產(chǎn)生的影響。在近幾年來(lái),海上運(yùn)輸法律制度出現(xiàn)了許多新的發(fā)展,包括承運(yùn)人責(zé)任基礎(chǔ)的變化、救助公約的變革、《約克─安特衛(wèi)普規(guī)則》的新發(fā)展。本文分析了這些相關(guān)制度的變革對(duì)共同海損制度產(chǎn)生了怎么樣的影響,是否會(huì)加劇理論界對(duì)共同海損制度消亡的傾向的問(wèn)題。在分析了這些新形勢(shì)下的一些變革后,本文接著從法的價(jià)值、法律經(jīng)濟(jì)學(xué)角度對(duì)共同海損存在的意義和價(jià)值進(jìn)行了分析。在分析中,明確了作為一項(xiàng)法律制度需要考慮的各種價(jià)值標(biāo)準(zhǔn),主要從公平、效率與成本三者之間的平衡進(jìn)行了比較,何者是更為優(yōu)先的法律價(jià)值,哪個(gè)更為當(dāng)前所需要。同時(shí),運(yùn)用了法律經(jīng)濟(jì)學(xué)的一些原理,從經(jīng)濟(jì)成本的角度考慮這一制度之存廢的利弊。通過(guò)這一系列的理論分析,確定了共同海損制度在當(dāng)前還有其存在的法律、經(jīng)濟(jì)價(jià)值。最后,在認(rèn)識(shí)到共同海損制度將長(zhǎng)期存在,,所謂的消亡將是一個(gè)漫長(zhǎng)而遙遠(yuǎn)的過(guò)程后,文章繼而分析了這一制度在一段時(shí)間內(nèi)的發(fā)展趨勢(shì)。如何簡(jiǎn)化分?jǐn)偫硭,如何平衡船貨雙方在之中的利益,國(guó)際間法律法規(guī)會(huì)有怎樣的修改編訂。同時(shí),在這樣的形勢(shì)下,我國(guó)國(guó)內(nèi)立法應(yīng)該如何應(yīng)對(duì)。在不斷發(fā)展的新形勢(shì)下,我國(guó)法律也需要進(jìn)行修改和補(bǔ)充,與時(shí)俱進(jìn)跟上時(shí)代步伐,更好地規(guī)范國(guó)內(nèi)的航運(yùn)市場(chǎng),保護(hù)各方的合法權(quán)益。
[Abstract]:In this paper, the current general average system is evaluated and analyzed. Firstly, the influence of the new development of the current maritime transport system on the general average system is analyzed. In recent years, there have been many new developments in the legal system of maritime transport, including the change of carrier's liability basis, the reform of salvage convention, and the new development of "York-Antwerp Rule". In this paper, the author analyzes how the reform of these related systems has influenced the general average system and whether it will aggravate the tendency of the theorists to die out of the general average system. After analyzing some changes in these new situations, this paper then analyzes the significance and value of the existence of general average from the point of view of the value of law and legal economics. In the analysis, the author clarifies all kinds of value standards which need to be considered as a legal system, mainly compares the balance among fairness, efficiency and cost, which is the priority of legal value and which needs more at present. At the same time, some principles of law and economics are applied to consider the advantages and disadvantages of this system from the angle of economic cost. Through this series of theoretical analysis, we determine the legal and economic value of the general average system at present. Finally, after recognizing that the system of general average will exist for a long time and that the so-called extinction will be a long and distant process, the paper then analyzes the development trend of the system for a period of time. How to simplify the allocation adjustment, how to balance the interests of both parties, how the international laws and regulations will be revised. At the same time, in such a situation, our domestic legislation should be how to deal with. In the new situation of continuous development, the law of our country also needs to be amended and supplemented, keep pace with the times, better regulate the domestic shipping market, protect the legitimate rights and interests of all parties.
