【摘要】： 本文意旨在對(duì)具有較強(qiáng)特殊性的海上保險(xiǎn)利益問(wèn)題進(jìn)行較為深入、系統(tǒng)的研究,以期對(duì)司法界和實(shí)務(wù)界提供一定的參考。為此,筆者以我國(guó)現(xiàn)行的《保險(xiǎn)法》和《海商法》為依據(jù),參照英國(guó)《1906年海上保險(xiǎn)法》有關(guān)保險(xiǎn)利益的規(guī)定,結(jié)合國(guó)內(nèi)外保險(xiǎn)實(shí)務(wù)及司法實(shí)踐,對(duì)我國(guó)海上保險(xiǎn)利益的確定和適用上存在的問(wèn)題進(jìn)行了研究和分析,論述了海上保險(xiǎn)利益的效力問(wèn)題,并運(yùn)用大量案例分別就海上貨物運(yùn)輸保險(xiǎn)利益、船舶保險(xiǎn)利益中的特殊問(wèn)題進(jìn)行了較為詳述的闡釋。并在此基礎(chǔ)上提出了相關(guān)立法建議。 本篇論文分為4章。第1章對(duì)海上保險(xiǎn)下保險(xiǎn)利益作了概述,首先通過(guò)各國(guó)立法例對(duì)海上保險(xiǎn)下保險(xiǎn)利益作了界定;其次論述了海上保險(xiǎn)利益的有效維持,包括對(duì)人效力和時(shí)間效力;最后對(duì)實(shí)務(wù)中如何判定財(cái)產(chǎn)保險(xiǎn)利益作了分析。第2章論述了海上貨物運(yùn)輸保險(xiǎn)中的保險(xiǎn)利益。本章分為三個(gè)部分,第一部分是概述海上貨物保險(xiǎn)中保險(xiǎn)利益的特殊性;第二部分介紹了對(duì)海上貨物運(yùn)輸保險(xiǎn)具有保險(xiǎn)利益的人;最后論述了現(xiàn)代國(guó)際貿(mào)易和技術(shù)發(fā)展對(duì)海上貨物運(yùn)輸保險(xiǎn)利益確定的影響。第3章論述了船舶保險(xiǎn)利益。本章分為四個(gè)部分,第一部分對(duì)船舶保險(xiǎn)利益作了概述;第二部分對(duì)建造中船舶的保險(xiǎn)利益作了詳細(xì)的論述;第三部分重點(diǎn)論述了船舶抵押權(quán)人保險(xiǎn)中的保險(xiǎn)利益問(wèn)題;第四部分對(duì)船舶經(jīng)營(yíng)管理人的保險(xiǎn)利益問(wèn)題進(jìn)行研究。第4章針對(duì)前文論述的我國(guó)現(xiàn)行立法在海上保險(xiǎn)利益方面存在的缺陷提出了相關(guān)的立法建議。
[Abstract]:The purpose of this paper is to make a deep and systematic study on the interest of marine insurance, which has strong particularity, in order to provide a certain reference for the judicial and practical circles. Therefore, based on the existing insurance law and maritime law of our country, and referring to the relevant provisions of the British Marine Insurance Law of 1906, the author combines the insurance practice and judicial practice at home and abroad. This paper studies and analyzes the problems existing in the determination and application of marine insurance interests in China, discusses the effectiveness of marine insurance interests, and applies a large number of cases to analyze the interests of marine cargo transportation insurance. The special problems in the interest of marine insurance are explained in detail. On this basis, the relevant legislative suggestions are put forward. This paper is divided into four chapters. Chapter 1 gives an overview of the interests of insurance under marine insurance. Firstly, it defines the interests of insurance under marine insurance through the legislation of various countries, and then discusses the effective maintenance of the interests of marine insurance, including the validity to human beings and the validity of time. Finally, how to judge the property insurance interests in practice is analyzed. Chapter 2 discusses the insurance interests in marine cargo insurance. This chapter is divided into three parts, the first part is an overview of the particularity of insurance interests in marine cargo insurance, the second part introduces the people who have insurance interests in marine cargo insurance. At last, it discusses the influence of modern international trade and technology development on the insurance benefits of marine cargo transportation. Chapter 3 discusses the interest of ship insurance. This chapter is divided into four parts, the first part gives an overview of the interests of marine insurance; the second part discusses the insurance interests of ships under construction in detail; the third part focuses on the insurance interests of the mortgagee; The fourth part studies the insurance interests of ship manager. Chapter 4 puts forward some legislative suggestions on the defects of the current legislation of our country in marine insurance interest.
