【摘要】：票據(jù)權(quán)利的善意取得制度是票據(jù)法中的一項(xiàng)十分重要的制度。票據(jù)的流通性是票據(jù)產(chǎn)生的根本原因，也是票據(jù)經(jīng)久不衰的強(qiáng)大的生命力所在。票據(jù)權(quán)利善意取得制度就是為了保障票據(jù)的流通性，，實(shí)現(xiàn)法的社會(huì)公正價(jià)值和法的經(jīng)濟(jì)效益價(jià)值而做的一項(xiàng)特殊制度設(shè)計(jì)。本文從動(dòng)產(chǎn)善意取得制度入手，推導(dǎo)出票據(jù)權(quán)利善意取得制度的理論淵源和實(shí)踐依據(jù)，深入分析了動(dòng)產(chǎn)善意取得制度與票據(jù)權(quán)利善意取得制度的異同，進(jìn)而全面論述了票據(jù)權(quán)利善意取得制度的構(gòu)成要件及其效力，并在考察國(guó)際通行作法的基礎(chǔ)上，結(jié)合我國(guó)司法實(shí)踐出現(xiàn)的一些情況，對(duì)票據(jù)法中有爭(zhēng)議的法條闡述了自己的理解，有針對(duì)性地提出了一些有關(guān)票據(jù)權(quán)利善意取得的可行性立法建議，例如確定空白票據(jù)的可適用性問(wèn)題、重大過(guò)失的標(biāo)準(zhǔn)問(wèn)題、支付對(duì)價(jià)的具體的可操作性標(biāo)準(zhǔn)問(wèn)題、舉證責(zé)任的分配問(wèn)題等等�？傊�，我國(guó)現(xiàn)行的票據(jù)法中有關(guān)票據(jù)權(quán)利善意取得制度雖然已經(jīng)體現(xiàn)了其國(guó)際性、統(tǒng)一性和適當(dāng)超前性的特點(diǎn)，但仍需進(jìn)一步修改和完善，以期在市場(chǎng)經(jīng)濟(jì)中發(fā)揮其更大的作用。
[Abstract]:The system of bona fide acquisition of bill rights is a very important system in negotiable instrument law. The circulation of bills is the root cause of bills, and also the strong vitality of bills. The system of bona fide acquisition of bill rights is a special system designed to guarantee the circulation of bills, to realize the value of social justice of law and the value of economic benefit of law. Starting with the system of bona fide acquisition of movable property, this paper deduces the theoretical origin and practical basis of bona fide acquisition system of bill rights, and analyses the similarities and differences between the system of bona fide acquisition of movable property and the system of bona fide acquisition of bill rights. Then, the paper comprehensively discusses the constitution and effect of bona fide acquisition system of bill right, and on the basis of investigating international prevailing practice, combining with some situations of judicial practice in our country, This paper expounds his own understanding of the controversial articles in the negotiable instrument law, and puts forward some feasible legislative proposals concerning the bona fide acquisition of bill rights, such as the determination of the applicability of blank instruments, the standard of gross negligence, The specific operational standard of payment consideration, the allocation of burden of proof and so on. In a word, although the system of bona fide acquisition of bill rights in the current negotiable instrument law of our country has already reflected its characteristics of internationality, unity and proper advance, it still needs to be further revised and perfected. With a view to playing a greater role in the market economy.
