以國際民商事關(guān)系作為調(diào)整對象的國際私法的傳統(tǒng)功能是法律選擇，實現(xiàn)這種功能的載體是沖突法制度。隨著國際民商事關(guān)系的蓬勃發(fā)展和國際私法呈現(xiàn)出的統(tǒng)一化趨勢，加之沖突法制度的固有缺陷，使得國際私法的功能必然要逐漸演進(jìn)為法律協(xié)調(diào)。與法律協(xié)調(diào)功能相適應(yīng)，國際私法的范圍除了包括沖突法外，還應(yīng)涵納國際統(tǒng)一實體法，兩類規(guī)范相輔相成，互為補(bǔ)充，，共同完成對國際民商事關(guān)系的調(diào)整。
