【摘要】：發(fā)展是人類社會永恒的主題,是當(dāng)今世界各國普遍關(guān)注又為之付出艱辛代價的焦點問題�，F(xiàn)實中的可持續(xù)發(fā)展問題總是同一定范圍的社會生活、社會運行緊密相連的,其中也必然涉及到為社會生活的持續(xù)運行提供價值判斷和秩序保障的法律體系。本文以可持續(xù)發(fā)展思想的最初形成到可持續(xù)發(fā)展思想滲透到經(jīng)濟、社會和資源環(huán)境等各個領(lǐng)域,到最后形成可持續(xù)發(fā)展理論并為我國確認為邁向21世紀(jì)的國家戰(zhàn)略為基本邏輯出發(fā)點,結(jié)合我國的基本國情,羅列和分析了我國在走向新世紀(jì)的過程中所面臨的人口、經(jīng)濟、社會、資源、環(huán)境等許多與可持續(xù)發(fā)展理論不協(xié)調(diào)的問題,探討了可持續(xù)發(fā)展理論給我們帶來的新的經(jīng)濟和社會發(fā)展觀,進而具體分析了可持續(xù)發(fā)展理論對我國傳統(tǒng)法律體系建構(gòu)過程中所產(chǎn)生的新的價值導(dǎo)向和重構(gòu)要求,并在此基礎(chǔ)上,討論了現(xiàn)代經(jīng)濟法對可持續(xù)發(fā)展戰(zhàn)略保障作用。 本文分為四個部分: 國民經(jīng)濟、社會發(fā)展和環(huán)境資源問題的表象描述及出路選擇。 這一章主要是對我國在完成了國民經(jīng)濟和社會發(fā)展的第二步戰(zhàn)略部署,走向新世紀(jì),開始為實施第三步戰(zhàn)略部署時所面對的經(jīng)濟效益、經(jīng)濟結(jié)構(gòu)、人口膨脹、環(huán)境污染、資源遭受破壞、貧富差距擴大、公平效率失衡等問題進行表象性的描述。作 WP=3 者同時對受幾十年計劃經(jīng)濟體制影響行政管理體制進行試探性地反思,從而提出為保障國民經(jīng)濟和社會的持續(xù)、快速、健康地發(fā)展必須要完成的從經(jīng)濟體制到經(jīng)濟發(fā)展模式的兩大轉(zhuǎn)變。 “可持續(xù)發(fā)展”提出的歷史脈絡(luò)及其內(nèi)涵特征。這一章有選擇 地介紹了可持續(xù)發(fā)展理論從最初的緣起到可持續(xù)發(fā)展理論的形成過程,并粗略地評析了可持續(xù)發(fā)展思想在各發(fā)展階段對社會生活實踐的價值和功效,表明了可持續(xù)發(fā)展戰(zhàn)略是當(dāng)代中國及未來的必然選擇。文章在對可持續(xù)發(fā)展理論的內(nèi)涵及特征進行分析的基礎(chǔ)上,提出了經(jīng)濟持續(xù)、生態(tài)持續(xù)、社會持續(xù)三者之間的辯證統(tǒng)一關(guān)系。 可持續(xù)發(fā)展戰(zhàn)略下的中國經(jīng)濟法的價值取向。這一章?lián)撝?lián) 結(jié)“可持續(xù)發(fā)展戰(zhàn)略”與“現(xiàn)代經(jīng)濟法”的任務(wù),是整篇文章比較關(guān)鍵的部分。本章再次對實施可持續(xù)發(fā)展戰(zhàn)略過程中存在的由于舊有的經(jīng)濟體制和社會經(jīng)濟管理模式而產(chǎn)生矛盾和問題進行責(zé)難,從而提出正本清源的問題:“我們搞經(jīng)濟建設(shè),追求經(jīng)濟增長究竟是為了什么?”關(guān)注人類當(dāng)前和未來的命運是可持續(xù)發(fā)展思想的由來的根本。從而提出“作為國家經(jīng)濟政策法律化形式的各法律部門必須在新的歷史條件下為貫徹落實可持續(xù)發(fā)展戰(zhàn)略發(fā)揮自己應(yīng)有的規(guī)范、引導(dǎo)作用,圍繞國家經(jīng)濟政策的發(fā)展變化相應(yīng)對法律體系設(shè)置、法律調(diào)整模式和法律規(guī)范做出調(diào)整和重新規(guī)劃”,并進一步提出和論述經(jīng)濟法應(yīng)在可持續(xù)發(fā)展戰(zhàn)略下做出的相應(yīng)價值選擇和價值追求。 運用現(xiàn)代經(jīng)濟法保障可持續(xù)發(fā)展戰(zhàn)略的實現(xiàn)。這一章是全文的 核心部分,著墨最多。在這部分,文章首先分析和論證了舊有體制下或帶有舊體制痕跡的傳統(tǒng)法律體系不適應(yīng)當(dāng)前市場經(jīng)濟發(fā)展的內(nèi)在要求,分別分析了民商法和行政法對經(jīng)濟關(guān)系調(diào)整的局限,繼而借用“公法”、“私法”概念分析它們各自對實現(xiàn)社會整體目標(biāo)與社會個體目標(biāo)之間矛盾化解的不足,并就當(dāng)前法學(xué)領(lǐng)域出現(xiàn)的大量“私法公法化”和“公法私法化”雙向作用的情形,提出建構(gòu)“第三法域”——文中指向為“現(xiàn)代經(jīng)濟法”(涉及到與有的學(xué)者歸結(jié)的“社會法”之間可能產(chǎn)生的爭議,作者已在結(jié)束語中作了解說)。其后,在前部分論述的基礎(chǔ)上,分析了現(xiàn)代 WP=4 經(jīng)濟法對社會經(jīng)濟關(guān)系的調(diào)整與民商法、行政法調(diào)整的不同之處,強調(diào)經(jīng)濟法對社會經(jīng)濟關(guān)系調(diào)整的特征是:公共利益和社會整體利益。調(diào)整的目的是:“為了自由而干預(yù)、限制,而不是通過干預(yù)而限制乃至扼殺經(jīng)濟自由”,同時,也補充說明了經(jīng)濟法的出現(xiàn)并非是為了搶奪地盤,民商法、行政法各自承擔(dān)了對社會經(jīng)濟關(guān)系調(diào)整的不同角色,提出法律對社會經(jīng)濟關(guān)系在客觀上存在多重調(diào)整或者是綜合調(diào)整可能。接著,文中論述了保障環(huán)境的可持續(xù)和社會的可持續(xù)“主要和最終地要依靠國家運用經(jīng)濟法對社會生活實行干預(yù)和調(diào)控才能達到最佳效果”。最后,文中分項而具體地論證了如何來健全國家宏觀調(diào)控法律制度來保障經(jīng)濟運行、資源環(huán)境和人口社會的可持續(xù)發(fā)展。 文章的結(jié)束語中對作者本人所感到的缺憾部分進行了一定的補救說明。
[Abstract]:The development is the eternal theme of the human society , which is the focus problem of the common concern of the world and the arduous cost . The sustainable development problem in reality is always connected with the social life and social operation in a certain range . In this paper , the author points out the new economic and social development view that the sustainable development thought has brought to us .
