【摘要】: 本文以海上承運(yùn)人的責(zé)任期間為研究對(duì)象,通過(guò)比較國(guó)內(nèi)審判實(shí)務(wù)、相關(guān)國(guó)際公約、正在起草的運(yùn)輸法草案等,分析我國(guó)《海商法》中責(zé)任期間制度所面臨的問(wèn)題,并提出解決方案。 遵循提出問(wèn)題、分析問(wèn)題、解決問(wèn)題的思路,全文分為以下幾個(gè)部分: 引言闡明論文的選題意義、當(dāng)前研究現(xiàn)狀、論文的目的以及研究路徑與方法。 第一章介紹海上貨物運(yùn)輸合同的類型,明確本文所討論的貨物運(yùn)輸類型為提單運(yùn)輸,介紹提單運(yùn)輸和責(zé)任期間的關(guān)系,并提出本文所要解決的問(wèn)題。 第二章界定責(zé)任期間的概念。本章首先介紹國(guó)內(nèi)所存在的爭(zhēng)議,然后比較我國(guó)臺(tái)灣地區(qū)學(xué)者的定義,以及《海牙規(guī)則》、《維斯比規(guī)則》、《漢堡規(guī)則》和運(yùn)輸法草案中的規(guī)定,得出《海商法》中的責(zé)任期間僅為強(qiáng)制責(zé)任期間;之后比較該強(qiáng)制責(zé)任期間、一般責(zé)任期間、法律適用期間、責(zé)任范圍和合同期間等幾個(gè)概念的差別和聯(lián)系。 第三章主要分析責(zé)任和強(qiáng)制責(zé)任期間的關(guān)系。本章首先從歷史的角度討論責(zé)任和強(qiáng)制責(zé)任期間的發(fā)展變化,分析《海牙規(guī)則》、《維斯比規(guī)則》和《漢堡規(guī)則》里的不足,并對(duì)運(yùn)輸法草案里的規(guī)定進(jìn)行評(píng)價(jià)。以此為基礎(chǔ),對(duì)我國(guó)《海商法》進(jìn)行分析,指出強(qiáng)制責(zé)任期間內(nèi)承運(yùn)人的主給付義務(wù)為運(yùn)輸義務(wù),而一般責(zé)任期間內(nèi)承運(yùn)人的主給付義務(wù)為運(yùn)輸和交付義務(wù)。 第四章則具體討論責(zé)任期間和強(qiáng)制責(zé)任期間的存續(xù)期間。本章首先概要介紹強(qiáng)制責(zé)任期間存續(xù)期間的發(fā)展過(guò)程,然后具體分析實(shí)際承運(yùn)人、多式聯(lián)運(yùn)經(jīng)營(yíng)人和無(wú)船承運(yùn)人在我國(guó)《海商法》下的強(qiáng)制責(zé)任期間和一般責(zé)任期間。最后分析強(qiáng)制責(zé)任期間和一般責(zé)任期間開(kāi)始和終結(jié)的標(biāo)準(zhǔn)。 第五章首先介紹其它貨物運(yùn)輸方式的責(zé)任期間,然后討論該責(zé)任期間和海上承運(yùn)人的責(zé)任期間的銜接問(wèn)題。本章共討論五種運(yùn)輸方式,至于管道運(yùn)輸,雖然不屬于合同法第17章所調(diào)整的貨物運(yùn)輸方式,鑒于其在現(xiàn)實(shí)中應(yīng)用的比較廣泛,也在該章中一并討論。 最后一部分為結(jié)語(yǔ)。首先對(duì)本文的觀點(diǎn)進(jìn)行總結(jié)和概括,然后提出修改建議。
[Abstract]:This paper takes the period of liability of the maritime carrier as the research object, analyzes the problems faced by the liability period system in Maritime Law of China by comparing domestic trial practice, relevant international conventions and the draft of the transport law that is being drafted. And put forward the solution. Following the ideas of problem raising, problem analysis and problem solving, the paper is divided into the following parts: The introduction clarifies the significance of the topic, the current research situation, the purpose of the paper, and the research path and method. The first chapter introduces the type of contract of carriage of goods by sea. It is clear that the type of transport of goods discussed in this paper is the transport of bill of lading. It introduces the relationship between bill of lading transportation and liability period, and puts forward the problems to be solved in this paper. The second chapter defines the concept of the period of responsibility. This chapter first introduces the domestic disputes, and then compares the definitions of scholars in Taiwan and the provisions of the Hague rules, Visby rules, Hamburg rules and the draft Transport Law. It is concluded that the period of liability in Maritime Law is only the period of compulsory liability, and then the differences and relations between the concepts of the period of compulsory liability, the period of general liability, the period of application of law, the scope of liability and the period of contract are compared. The third chapter mainly analyzes the relationship between the period of liability and compulsory liability. This chapter first discusses the development of liability and compulsory liability from a historical point of view, analyzes the shortcomings of the Hague rules, the Visby rules and the Hamburg rules, and evaluates the provisions of the draft Transport Law. Based on this analysis, the author points out that the carrier's main obligation during the period of compulsory liability is the obligation of carriage, while the obligation of carrier's main payment during the period of general liability is the obligation of carriage and delivery. The fourth chapter discusses the period of liability and the period of compulsory liability. This chapter firstly introduces the developing process of the period of compulsory liability, and then analyzes the period of compulsory liability and the period of general liability of actual carrier, multimodal transport operator and non-ship carrier under the Maritime Law of China. Finally, it analyzes the criteria for the beginning and end of compulsory liability period and general liability period. Chapter five first introduces the period of responsibility of other modes of carriage of goods, and then discusses the connection between the period of responsibility and that of the carrier at sea. This chapter discusses five modes of transport, as for pipeline transportation, although it is not part of the freight transport mode adjusted in Chapter 17 of the contract Law, it is also discussed in this chapter in view of its wide application in reality. The last part is the conclusion. First of all, summarize and summarize the views of this paper, and then put forward suggestions for modification.
