海上傾廢損害賠償?shù)呢?zé)任限制問題研究

【摘要】:在司法實(shí)踐中海事賠償責(zé)任限制引起的海事糾紛比比皆是,而經(jīng)濟(jì)迅猛發(fā)展的當(dāng)下社會,關(guān)于海上傾廢造成海洋污染損害引起相關(guān)索賠的案件也愈加增多。但我國《海商法》及有關(guān)司法解釋并沒有對海上傾廢這種行為的性質(zhì)作出明確界定,更無相關(guān)法律對此種行為引起的海事賠償請求權(quán)是否可以適用海事賠償責(zé)任限制以及如何適用責(zé)任限制加以規(guī)定。本文對該問題運(yùn)用案例分析、對比分析等多種方法進(jìn)行了研究,試圖對解決由于海上傾廢行為引起損害賠償責(zé)任限制問題的案件處理提出有益的幫助。 除引言和結(jié)論外,本文分為三部分。 第一部分為海上傾廢污染概述。首先是對“海上傾廢”及“傾廢污染”的界定,并與其他海洋污染行為進(jìn)行區(qū)別,如船舶污染。其次是對防止海上傾廢污染海洋的立法現(xiàn)狀的梳理,介紹相關(guān)國際公約以及國內(nèi)對海洋傾廢管理的立法現(xiàn)狀。最后從法律梳理的過程中說明研究海上傾廢損害賠償責(zé)任限制問題的必要性。 第二部分為海上傾廢污染損害賠償責(zé)任限制之爭。這部分以案例分析為主,即以司法實(shí)踐中對海上傾廢污染損害賠償責(zé)任限制案例的處理方法為切入點(diǎn),引出學(xué)界對此的不同觀點(diǎn)和其觀點(diǎn)的理論依據(jù)并進(jìn)行評析;重點(diǎn)對海上傾廢行為的性質(zhì),此行為引起的賠償請求是否屬于海商法調(diào)整范圍的限制性債權(quán)等進(jìn)行研究。 第三部分討論承認(rèn)海上傾廢污染損害賠償請求屬于限制性債權(quán)所面臨的現(xiàn)實(shí)問題和完善建議。這些問題包括:喪失責(zé)任限制權(quán)利的條件,包括主觀條件、實(shí)施行為主體條件、因果關(guān)系要件及損失的同一性要件;責(zé)任限額問題;如何確定事故的次數(shù),即對在從事傾倒多船廢物或者多次傾倒廢物等行為的情況下,計(jì)算責(zé)任限額時(shí),如何確定事故次數(shù)的問題。
[Abstract]:In judicial practice, maritime disputes caused by limitation of liability for maritime claims are everywhere, and in the current society with rapid economic development, there are more and more cases of claims for marine pollution damage caused by dumping at sea. However, the nature of dumping at sea has not been clearly defined in China's Maritime Law and related judicial interpretations. There is no relevant law on whether the maritime claims arising from such acts can be applied to the limitation of liability for maritime claims and how to apply the limitation of liability. This paper studies the problem by case analysis, comparative analysis and other methods, trying to solve the problem of liability limitation of damage caused by dumping at sea. In addition to the introduction and conclusions, this paper is divided into three parts. The first part is an overview of dumping pollution at sea. The first is the definition of "dumping at sea" and "dumping pollution", and distinguishes it from other marine pollution behaviors, such as marine pollution. Secondly, the current legislative status of marine dumping pollution is reviewed, and the relevant international conventions and domestic legislative status of marine dumping management are introduced. Finally, the necessity of studying the limitation of liability for dumping damages at sea is explained in the process of legal combing. The second part is the dispute about limitation of liability for pollution damage caused by dumping pollution at sea. This part is mainly case analysis, that is, the method of dealing with the case of limitation of liability for pollution damage caused by dumping pollution at sea in judicial practice is the breakthrough point, which leads to the different viewpoints of academic circles and the theoretical basis of their views and comments. This paper focuses on the nature of dumping at sea and whether the claims caused by this act belong to restrictive claims in the scope of maritime law adjustment and so on. The third part discusses the practical problems and suggestions of admitting that the claim for pollution damage from dumping at sea is a restrictive claim. These problems include: the condition of losing the right of limitation of liability, including the subjective condition, the condition of the subject of the act, the element of causality and the identity of the loss, the question of the limitation of liability, how to determine the number of accidents, That is, how to determine the number of accidents in the case of dumping multi-ship wastes or dumping wastes many times, when calculating the limit of liability.
