【摘要】：正 德國的統(tǒng)一與《民法典》的產(chǎn)生 《德國民法典》于1896年公布,從20世紀之始起施行。19世紀70年代前,德國處于尚未統(tǒng)一的割據(jù)狀態(tài),在當時由普魯士、奧地利諸候構(gòu)成的所謂“神圣羅馬帝國”,法律是極不統(tǒng)一的,在私法方面,各邦也“各自為政”。但在全德范圍內(nèi),并存著羅馬法和日耳曼法。自18世紀中葉,在德意志各邦中就開始了民法典的編纂活動。巴伐利亞、普魯士、奧地利等邦在統(tǒng)一前均頒布了各自的民法典。而萊茵河地區(qū)在受到拿破侖的法國軍隊占領(lǐng)后,曾一度適用《拿破侖法典》。在統(tǒng)一前,德國曾有制定民法典的強烈呼聲,但未能付諸實施,一方面
