創(chuàng)設(shè)船舶用益物權(quán)制度之研究

【摘要】: 我國(guó)《海商法》第二章“船舶”規(guī)定了四種以船舶為客體的船舶物權(quán),分別是船舶所有權(quán)、船舶抵押權(quán)、船舶優(yōu)先權(quán)以及船舶留置權(quán)。根據(jù)權(quán)利屬性的劃分,除了船舶所有權(quán)外,其他三種權(quán)利均屬擔(dān)保物權(quán)。盡管《海商法》沒(méi)有出現(xiàn)船舶用益物權(quán)的概念,也沒(méi)有規(guī)定任何具體類(lèi)型的用益物權(quán),但是光船租賃實(shí)際上符合了以船舶為客體的用益物權(quán)的法律特征。隨著我國(guó)《物權(quán)法》的制定以及實(shí)施,我國(guó)物權(quán)體系基本建立,而作為特別法的海商法船舶物權(quán)體系應(yīng)隨之完善。創(chuàng)設(shè)船舶用益物權(quán)制度對(duì)于海商法船舶物權(quán)體系的完善具有一定的意義。 本文采取了比較研究的方法,對(duì)于船舶物權(quán)的研究,首先在作為一般法的民法、物權(quán)法中尋求一般規(guī)則,然后結(jié)合船舶以及海事實(shí)踐的特殊性,研究創(chuàng)設(shè)船舶用益物權(quán)制度的理論基礎(chǔ)和現(xiàn)實(shí)意義。 在本文中,筆者首先闡述了我國(guó)《物權(quán)法》規(guī)定的用益物權(quán)定義及其特征,然后根據(jù)我國(guó)《海商法》未明確規(guī)定船舶用益物權(quán)的立法現(xiàn)狀,.歸納了我國(guó)學(xué)界目前對(duì)于船舶用益物權(quán)的研究情況。接下來(lái)筆者根據(jù)一般法民法、物權(quán)法的基本理論,探求設(shè)立船舶用益物權(quán)的理論基礎(chǔ)。然后就船舶用益物權(quán)存在與否的焦點(diǎn)問(wèn)題——光船租賃權(quán)的性質(zhì)進(jìn)行了比較分析,得出該權(quán)利更具用益物權(quán)屬性的結(jié)論,并明確光船租賃權(quán)即為船舶用益物權(quán)的主要內(nèi)容。最后本文闡明了創(chuàng)設(shè)船舶用益物權(quán)制度的現(xiàn)實(shí)意義,并對(duì)創(chuàng)設(shè)用益物權(quán)制度應(yīng)注意的問(wèn)題提出看法。
[Abstract]:The second chapter of China's Maritime Law, "ship", stipulates four kinds of ship real right, which are ship ownership, ship mortgage, ship lien and ship lien. According to the division of rights, the other three rights are security interests except ship ownership. Although there is no concept of usufruct of ship and no specific type of usufruct is stipulated in Maritime Law, bareboat charter actually accords with the legal characteristics of usufruct with ship as its object. With the establishment and implementation of Real right Law in China, the system of real right in our country is basically established, and the maritime law system of real right of ships as a special law should be perfected. The establishment of the usufruct system of ships has certain significance for the perfection of the maritime law system of real rights of ships. This paper adopts the method of comparative study. For the study of ship real right, we first seek general rules in civil law and property law as general law, and then combine the particularity of ship and maritime practice. The theoretical basis and practical significance of establishing the system of usufruct of ships are studied. In this paper, the author first expounds the definition and characteristics of usufruct in China's Real right Law, and then according to the fact that the Maritime Law of China has not clearly stipulated the legislative situation of ship usufruct right. This paper summarizes the current research on the usufruct of ships in Chinese academic circles. Then the author explores the theoretical basis of the establishment of usufruct right of ships according to the basic theories of general civil law and property law. Then, the author makes a comparative analysis on the existence or not of the usufruct of ships-the nature of the right of bareboat chartering, and draws the conclusion that the right is more property of usufruct, and makes clear that the right of bareboat chartering is the main content of usufruct of ship. Finally, this paper expounds the practical significance of creating the system of usufruct of ships, and puts forward some views on the problems that should be paid attention to in the system of usufruct of ships.
