食品安全信息披露規(guī)范性研究

【摘要】:食品安全信息披露是我國食品安全規(guī)范體系不可或缺的一部分,與發(fā)達國家相比,我國的食品安全信息披露規(guī)范性建設仍然處于起步階段,,信息披露不符合及時、易得、標準、充分等基本要求,沒有形成一個全面的、系統(tǒng)的、邏輯的規(guī)范體系。本文以研究我國現(xiàn)有食品安全信息披露規(guī)范存在的問題為出發(fā)點,從法學、經濟學、社會學等角度明確食品安全信息披露的理論依據(jù),企圖探索出一條能夠有效解決現(xiàn)行制度缺陷的路徑,并就完善我國食品安全信息披露規(guī)范性建設提出了一些建議。 全文的主要研究內容和結論共分為四章: 第一章主要為揭示我國現(xiàn)行食品安全規(guī)范存在的問題。為了更好的理解食品安全信息的相關內容,本章首先明確了食品安全信息的概念,并從不同角度對食品安全信息的種類做了一定劃分。其次分析了不同主體在食品安全信息披露方面存在的問題,并強調了現(xiàn)有食品安全信息披露不符合及時、易得、標準、充分等基本要求。 第二章從法學、經濟學、社會學的角度分析了食品安全信息披露的理論依據(jù),本章認為從法律視角來看,民商法、刑法對信息不對稱的規(guī)制,以及消費者知情權等都是規(guī)范食品安全信息披露的理論依據(jù),從經濟學、社會學的角度來看,消除信息不對稱對食品市場的負面影響是建立食品安全信息披露制度的最根本原因,同時規(guī)范的制度能夠提高生產經營者的社會責任感和保持食品市場的可持續(xù)發(fā)展。 第三章通過探討如何保證消費者知情權能夠有效實現(xiàn)、怎樣明確食品安全信息披露標準、建立有效的對政府監(jiān)管部門與生產經營者的追責機制和消費者救濟方式,嘗試探索出一條能夠有效解決現(xiàn)行信息披露制度缺陷的路徑。 第四章對完善我國食品安全信息披露規(guī)范性提出了幾點建議。本章首先提出完善我國食品安全信息披露規(guī)范性的總體思路是,有明確的信息披露義務主體,有明確的信息披露標準,以及應當拓寬信息披露的有效路徑。其次,針對前文分析的現(xiàn)行規(guī)范制度存在的問題,并與其他國家先進制度進行比較后,從信息發(fā)布制度、食品溯源機制、消費者教育等方面提出了完善我國食品安全信息披露規(guī)范的建議。
[Abstract]:Food safety information disclosure is an indispensable part of our food safety standard system. Compared with developed countries, the standardization construction of food safety information disclosure in our country is still in its infancy. Adequate and other basic requirements do not form a comprehensive, systematic, logical normative system. In this paper, the theoretical basis of food safety information disclosure is clarified from the angles of law, economics, sociology and so on, based on the study of the problems existing in the existing food safety information disclosure standards in China. This paper attempts to explore a path that can effectively solve the defects of the current system, and puts forward some suggestions for improving the standardization construction of food safety information disclosure in China. The main contents and conclusions of this paper are divided into four chapters: The first chapter is mainly to reveal the problems existing in the current food safety standards in China. In order to better understand the relevant content of food safety information, this chapter first clarified the concept of food safety information, and made a certain classification of food safety information from different angles. Secondly, it analyzes the problems of different subjects in food safety information disclosure, and emphasizes that the current food safety information disclosure does not meet the basic requirements of timely, easy to obtain, standard, adequate and so on. The second chapter analyzes the theoretical basis of food safety information disclosure from the angles of law, economics and sociology. And the right of consumers to know is the theoretical basis for regulating the disclosure of food safety information. From the angle of economics and sociology, Eliminating the negative influence of information asymmetry on food market is the most fundamental reason for establishing food safety information disclosure system. At the same time, the standardized system can improve the social responsibility of producers and operators and maintain the sustainable development of food market. The third chapter discusses how to ensure that consumers' right to know can be realized effectively, how to make clear the standard of food safety information disclosure, how to establish effective accountability mechanism and consumer relief for government supervision department and production operator. Try to explore a way that can effectively solve the defects of the current information disclosure system. The fourth chapter puts forward some suggestions to improve the standardization of food safety information disclosure in China. This chapter first puts forward the general idea of perfecting the standardization of food safety information disclosure in our country: there is a clear subject of information disclosure obligation, a clear standard of information disclosure, and the effective path of information disclosure should be broadened. Secondly, in view of the problems existing in the existing normative system of the previous analysis, and after comparing with the advanced systems of other countries, from the information release system, food traceability mechanism, Consumer education and other aspects of the improvement of food safety information disclosure standards.
