市場中介組織的經(jīng)濟法制度研究

【摘要】: 隨著我國市場經(jīng)濟的進一步發(fā)展和完善,市場中介組織作為一種新興的社會主體,在經(jīng)濟生活中起到越來越重要的作用。各類市場中介組織的法律問題,成為學(xué)界研究的又一理論熱點。 本文從市場中介組織的概念及特征入手,通過闡釋市場中介組織的作用和功能,結(jié)合社會學(xué)、經(jīng)濟學(xué)的方法,從感性認識逐步到理性認識來分析市場中介組織的法律定位,將市場中介組織定位為經(jīng)濟法主體。并在此基礎(chǔ)上進一步分析市場中介組織在我國發(fā)展的現(xiàn)狀及存在的問題,試圖找出對市場中介組織進行經(jīng)濟法調(diào)整的對策和完善法律的建議。文章主要立足中國國情,以經(jīng)濟法為中心,整合民商法、行政法,及社會學(xué)、政治學(xué),經(jīng)濟學(xué)等學(xué)科原理、研究方法和最新研究成果,對經(jīng)濟法學(xué)的特殊主體—市場中介組織加以研究,以期引起共鳴,完善我國的經(jīng)濟法基本理論。 首先,筆者提出市場中介組織的概念,并明確指出雖然在民事和行政法律關(guān)系中,也有市場中介組織的參與,但市場中介組織從其本質(zhì)意義上屬于經(jīng)濟法律關(guān)系的主體。其次,本文介紹了發(fā)達國家的市場中介組織發(fā)展概況,并提出對我國的啟示。通過分析,本文認為,我國市場中介組織存在的問題主要是:市場中介組織的獨立性較差;市場中介組織管理體制不順;市場中介組織結(jié)構(gòu)不合理;市場中介組織自身定位發(fā)生偏差;對市場中介組織的監(jiān)管不力等等。市場中介組織失靈直接導(dǎo)致經(jīng)濟法實現(xiàn)機制的扭曲,造成經(jīng)濟秩序的混亂和政府干預(yù)的失敗,為此,有必要對市場中介組織進行經(jīng)濟法調(diào)整。筆者認為,對市場中介組織進行經(jīng)濟法調(diào)整的重點應(yīng)放在以下幾個方面:規(guī)范市場中介組織的組織形式;完善市場中介組織的市場準入制度;簡化市場中介組織的組建程序;強化市場中介組織的自身建設(shè)提高中介服務(wù)的整體水平;加強對市場中介組織的執(zhí)法監(jiān)督。
[Abstract]:With the further development and perfection of our market economy, market intermediary organizations, as a new social subject, play an increasingly important role in economic life. The legal problems of various kinds of market intermediary organizations have become another theoretical hotspot of academic research. This paper starts with the concept and characteristics of market intermediary organization, analyzes the legal position of market intermediary organization by explaining the function and function of market intermediary organization, combining the methods of sociology and economics, from perceptual cognition to rational understanding. Market intermediary organizations will be positioned as the subject of economic law. On this basis, this paper further analyzes the current situation and existing problems of the development of market intermediary organizations in China, and tries to find out the countermeasures to adjust the economic law of market intermediary organizations and the suggestions to perfect the laws. The article is mainly based on China's national conditions, focusing on economic law, integrating civil and commercial law, administrative law, as well as the principles of sociology, political science, economics and other disciplines, research methods and the latest research results. The special subject of economic law, market intermediary organization, is studied in order to resonate and perfect the basic theory of economic law in our country. First of all, the author puts forward the concept of market intermediary organization, and points out clearly that although in civil and administrative legal relationship, market intermediary organization also has the participation of market intermediary organization, but market intermediary organization belongs to the subject of economic legal relation in essence. Secondly, this paper introduces the development of market intermediary organizations in developed countries, and puts forward the enlightenment to our country. Based on the analysis, this paper points out that the problems of market intermediary organization in China are: the independence of market intermediary organization is poor, the management system of market intermediary organization is not smooth, the structure of market intermediary organization is unreasonable, and the market intermediary organization structure is not reasonable. The market intermediary organization has its own positioning deviation; the supervision of the market intermediary organization is weak and so on. The failure of the market intermediary organization directly leads to the distortion of the realization mechanism of the economic law, the confusion of the economic order and the failure of the government intervention. Therefore, it is necessary to adjust the economic law to the market intermediary organization. The author thinks that the adjustment of market intermediary organization should focus on the following aspects: standardizing the organization form of market intermediary organization, perfecting the market access system of market intermediary organization, simplifying the procedure of setting up market intermediary organization; Strengthen the self-construction of market intermediary organizations to improve the overall level of intermediary services, strengthen the law enforcement supervision of market intermediary organizations.
