【摘要】:以歐盟和美國(guó)為代表的發(fā)達(dá)國(guó)家和地區(qū),歷來(lái)重視航運(yùn)競(jìng)爭(zhēng)法的研究,逐步建立了較為完善的航運(yùn)競(jìng)爭(zhēng)法,為促進(jìn)本國(guó)航運(yùn)市場(chǎng)的健康發(fā)展,奠定了堅(jiān)實(shí)的制度基礎(chǔ)。然而,我國(guó)長(zhǎng)期未能建立航運(yùn)競(jìng)爭(zhēng)法,相關(guān)的研究也處于極不發(fā)達(dá)的狀態(tài)。從2002年開(kāi)始,隨著我國(guó)進(jìn)一步開(kāi)放國(guó)際海上運(yùn)輸服務(wù)領(lǐng)域,一系列有關(guān)航運(yùn)競(jìng)爭(zhēng)的爭(zhēng)議接連爆發(fā)出來(lái)。這些爭(zhēng)議涉及面廣,影響巨大,造成托運(yùn)人和承運(yùn)人之間的關(guān)系,日益緊張。由于我國(guó)在航運(yùn)競(jìng)爭(zhēng)立法上仍然存在空白,這些爭(zhēng)議無(wú)法在我國(guó)法律的框架內(nèi),得到合理的解決。因此,航運(yùn)競(jìng)爭(zhēng)法的研究,是當(dāng)前我國(guó)公海商法研究的熱點(diǎn)和難點(diǎn)問(wèn)題,具有較強(qiáng)的現(xiàn)實(shí)意義和理論價(jià)值。 本文緊緊圍繞6個(gè)方面的內(nèi)容,對(duì)美國(guó)和歐盟的航運(yùn)競(jìng)爭(zhēng)法進(jìn)行了實(shí)證的和比較的研究。在比較的基礎(chǔ)上,本文結(jié)合我國(guó)的具體實(shí)際,提出了具體的和針對(duì)性的立法建議。 本文首先要解決的問(wèn)題是航運(yùn)競(jìng)爭(zhēng)法的概念問(wèn)題,這是第一章的主要內(nèi)容。探討的結(jié)論是,航運(yùn)競(jìng)爭(zhēng)法是調(diào)整航運(yùn)競(jìng)爭(zhēng)關(guān)系和競(jìng)爭(zhēng)管理關(guān)系的法律規(guī)范的總和,其外延應(yīng)當(dāng)包括海運(yùn)合作協(xié)議制度和航運(yùn)反傾銷制度等一系列航運(yùn)競(jìng)爭(zhēng)保護(hù)和航運(yùn)交易保護(hù)法律制度。 第二章是對(duì)歐美航運(yùn)競(jìng)爭(zhēng)法的微觀比較。通過(guò)精確到具體條文的對(duì)比,本文發(fā)現(xiàn)了歐美航運(yùn)競(jìng)爭(zhēng)法在法律技術(shù)層面的各種異同?偨Y(jié)和歸納之后,形成了2份表格,詳細(xì)列明了微觀比較的結(jié)果。 第三章則是對(duì)歐美航運(yùn)競(jìng)爭(zhēng)法異同的具體分析。通過(guò)分析影響歐美航運(yùn)競(jìng)爭(zhēng)立法的各種因素,本文揭示了造成歐美航運(yùn)競(jìng)爭(zhēng)法異同的幾個(gè)重要原因。歐美航運(yùn)競(jìng)爭(zhēng)法存在相同之處,與海運(yùn)合作協(xié)議本身的合理性和人們對(duì)自由競(jìng)爭(zhēng)的理性認(rèn)識(shí)有關(guān);歐美航運(yùn)競(jìng)爭(zhēng)法存在不同之處,是因?yàn)闅W美的航運(yùn)利益不同,美國(guó)代表托運(yùn)人的利益,歐盟代表承運(yùn)人的利益。第三章的一個(gè)最重要的結(jié)論是,航運(yùn)競(jìng)爭(zhēng)法由本國(guó)航運(yùn)利益決定,保護(hù)并促進(jìn)本國(guó)的航運(yùn)利益。 第四章立足于我國(guó)的實(shí)際情況,把第二章和第三章的結(jié)論,具體應(yīng)用到我國(guó)航運(yùn)競(jìng)爭(zhēng)立法的過(guò)程中來(lái)。本文研究了當(dāng)前我國(guó)國(guó)際海運(yùn)市場(chǎng)所發(fā)生的各種問(wèn)題,對(duì)我國(guó)的相關(guān)法律進(jìn)行了實(shí)證的研究,指出了我國(guó)法律存在的重大不足,論
[Abstract]:The developed countries and regions represented by the European Union and the United States have always attached importance to the study of the shipping competition law and have gradually established a relatively perfect shipping competition law, which has laid a solid institutional foundation for promoting the healthy development of the domestic shipping market. However, our country has not established the shipping competition law for a long time, the related research is also in the extremely underdeveloped state. Since 2002, with China's further opening up of international maritime transport services, a series of disputes about shipping competition have erupted one after another. These disputes are widespread and significant, creating growing tensions between shippers and carriers. As there are still gaps in the legislation of shipping competition in our country, these disputes cannot be reasonably resolved within the framework of our country's laws. Therefore, the study of shipping competition law is a hot and difficult issue in the current research of China's public maritime law, which has strong practical significance and theoretical value. This paper focuses on six aspects of the shipping competition law of the United States and the European Union empirical and comparative study. On the basis of comparison, this paper puts forward specific and pertinent legislative suggestions combined with our country's specific practice. The first problem to be solved in this paper is the concept of shipping competition law, which is the main content of the first chapter. The conclusion of the discussion is that the shipping competition law is the sum of the legal norms regulating the relationship between competition and competition in shipping. Its extension should include maritime cooperation agreement system, shipping anti-dumping system and a series of legal systems of shipping competition protection and shipping transaction protection. The second chapter is the microscopic comparison of European and American shipping competition law. Through the comparison of precise to specific articles, this paper finds the differences and similarities of European and American shipping competition law in legal and technical aspects. After summing up and summarizing, two tables were formed detailing the results of microscopic comparisons. The third chapter is the specific analysis of the similarities and differences of European and American shipping competition law. Based on the analysis of various factors affecting European and American shipping competition legislation, this paper reveals several important reasons for the similarities and differences of European and American shipping competition law. There are similarities between European and American shipping competition laws, which are related to the rationality of maritime cooperation agreements and people's rational understanding of free competition, and the differences in European and American shipping competition laws are due to the differences in shipping interests in Europe and the United States. The United States represents the interests of the shipper and the European Union represents the interests of the carrier. One of the most important conclusions of Chapter 3 is that the shipping competition law is determined by the domestic shipping interests and protects and promotes the domestic shipping interests. The fourth chapter is based on the actual situation of our country, and applies the conclusions of the second and third chapters to the process of our country's shipping competition legislation. This paper studies all kinds of problems in China's international shipping market, makes an empirical study on the relevant laws of our country, and points out the major deficiencies of our country's laws.
