《運輸法公約草案》下承運人責(zé)任形式問題研究

【摘要】: 隨著集裝箱運輸?shù)难该桶l(fā)展和物流經(jīng)濟的勃興,國際貨物多式聯(lián)運在經(jīng)濟全球化過程中的作用愈發(fā)重要。國際貨物多式聯(lián)運自誕生以來,一直呼喚著法律上的國際統(tǒng)一。然而,由于各種運輸方式受制于裝備水平、風(fēng)險程度乃至地緣政治等因素,所適用的國際規(guī)則和國內(nèi)立法在制度上也存在顯著差異,尤其在承運人責(zé)任方面的法律沖突表現(xiàn)的尤為突出。雖然聯(lián)合國、國際商會等國際組織在此方面已積極探索,但迄今為止仍未能形成一部具有法律效力的國際貨物多式聯(lián)運公約,極大地制約了國際多式聯(lián)運業(yè)的發(fā)展。 本文從海商法和多式聯(lián)運法律的基本理論出發(fā),以歷史分析的方法探尋《運輸法公約草案》(以下簡稱草案)下承運人責(zé)任形式的立法沿革和精神Qg核,同時借鑒法經(jīng)濟學(xué)的相關(guān)理論和觀點,立足最新立法成果,詳加研討和批判。由于草案已明確將承運人的責(zé)任區(qū)間從海運領(lǐng)域的“港到港”延伸至“門到門”,并規(guī)定了海運前后的承運人責(zé)任問題,以及未定域貨物責(zé)任問題,實際上,草案中的運輸合同已經(jīng)成為包含國際海運在內(nèi)的國際貨物運輸合同,因而草案下的承運人業(yè)已演變成為多式聯(lián)運經(jīng)營人,通過比較現(xiàn)有多式聯(lián)運經(jīng)營人責(zé)任形式的諸多淵源,本文將草案下承運人責(zé)任形式認(rèn)定為最小的網(wǎng)狀責(zé)任制,并據(jù)此提出了多式聯(lián)運經(jīng)營人責(zé)任形式的三層次理論。此外,為進(jìn)一步加深對承運人責(zé)任形式內(nèi)涵的闡釋,本文還著力研究了幾個與之密切相關(guān)的法律問題:草案包含的運輸類型、草案與其他國際單式運輸公約和國內(nèi)法的關(guān)系以及海運履約方制度之設(shè)計對承運人責(zé)任形式的影響。并對草案制度上存在的一些不足之處提出了個人見解。 最后,本文還提出我國多式聯(lián)運經(jīng)營人責(zé)任形式的初步法律框架。希望能對國際以及我國貨物多式聯(lián)運法律的研究和發(fā)展有所助益。
[Abstract]:With the rapid development of container transportation and the prosperity of logistics economy, international multimodal transport of goods plays an increasingly important role in the process of economic globalization.International multimodal transport of goods has been calling for international unification since its birth.However, due to the fact that various modes of transport are subject to such factors as the level of equipment, the degree of risk and even geopolitical factors, the applicable international rules and domestic legislation also differ significantly in terms of institutions.Especially in the carrier liability conflict of law performance is particularly prominent.Although international organizations, such as the United Nations and the International Chamber of Commerce, have actively explored this aspect, up to now, it has not been able to form a legally effective convention on international multimodal transport of goods, which has greatly restricted the development of international multimodal transport industry.Based on the basic theory of maritime law and multimodal transport law, this paper explores the legislative evolution and spirit QG core of carrier's liability form under the draft Convention on Transport Law (hereinafter referred to as "draft") through historical analysis.At the same time, draw lessons from the relevant theories and views of law and economics, based on the latest legislative results, detailed discussion and criticism.Since the draft has explicitly extended the carrier's liability zone from "port to port" in the field of maritime transport to "door-to-door", and has provided for the question of carrier's liability before and after maritime transport, as well as the question of liability for unsettled goods, in practice,The contract of carriage in the draft has become an international contract for the carriage of goods, including international maritime transport, so that the carrier under the draft has evolved into a multimodal transport operator, by comparing the many sources of responsibility of the existing multimodal transport operator,In this paper, the carrier's liability form under the draft is regarded as the smallest network responsibility system, and the three-level theory of multimodal transport operator's liability form is put forward.In addition, in order to further explain the form of carrier liability, this paper also focuses on several closely related legal issues: the type of transport included in the draft.The relationship between the draft and other international single-mode transport conventions and domestic law and the influence of the design of maritime performing party system on the carrier's form of liability.At the same time, the author puts forward some personal opinions on the deficiencies of the draft system.Finally, this article also proposed our country multimodal transport operator responsibility form preliminary legal frame.It is hoped that it will be helpful to the research and development of international and Chinese law of multimodal transport of goods.
