【摘要】: 限制性損害賠償責(zé)任是指在民事?lián)p害賠償責(zé)任中,依據(jù)法律規(guī)定,損害賠償責(zé)任人只在一定限額范圍內(nèi)承擔(dān)的金錢賠償責(zé)任。 限制性損害賠償責(zé)任是一個(gè)既老又新的研究課題。說其老,原因在于早在一千多年前,其已經(jīng)闖入了我們的生活;說其新,原因在于在過去的一千多年中,其無時(shí)無刻不在更新和拓展,同時(shí)目前對其不同種類做統(tǒng)一性研究的課題比較少,以此為角度具有新意。這就是在本文緒論中明了的一些背景內(nèi)容。 第一章為限制性損害賠償責(zé)任概論。本章通過詳細(xì)講述限制性損害賠償責(zé)任的概念、特征以及與類似概念的比較來界定什么是本文所討論的研究對象,從而構(gòu)建本文研究的平臺。 第二章為限制性損害賠償責(zé)任現(xiàn)狀論。本部分以第一章為基礎(chǔ),詳細(xì)搜尋了歷史發(fā)展中產(chǎn)生的各個(gè)不同類型的限制性損害賠償責(zé)任。從海商法上的海事賠償責(zé)任限制、承運(yùn)人責(zé)任限制、船舶油污損害賠償責(zé)任限制、港口經(jīng)營人賠償責(zé)任限制,到海商法外的航空損害賠償責(zé)任限制、鐵路運(yùn)輸損害賠償責(zé)任限制、郵政運(yùn)輸損害賠償責(zé)任限制、核損害賠償責(zé)任限制、國家損害賠償責(zé)任限制。這些限制性損害賠償責(zé)任展現(xiàn)了其蒸蒸日上且錯(cuò)綜復(fù)雜的發(fā)展軌跡。 第三章為限制性損害責(zé)任本體論。本部分是在第二章的基礎(chǔ)上,詳細(xì)抽象概括出限制性損害賠償責(zé)任的一般規(guī)律。這些一般規(guī)律包括:限制性損害賠償責(zé)任的構(gòu)成、屬性、分類及限制方法。這也是本文研究的階段性成果之一。 第四章為限制性損害賠償責(zé)任功能價(jià)值論。本部分的描述尋找限制性損害賠償責(zé)任存在的理由,在于具有重大的社會功能和價(jià)值。同時(shí),限制性損害賠償責(zé)任并非萬能的制度,其也存在缺陷,因此如何克服和彌補(bǔ)缺陷也是該制度發(fā)揮功能作用的關(guān)鍵所在。 在結(jié)論部分,筆者對文章本論做了一個(gè)簡短的總結(jié),并對我國未來限制性損害賠償責(zé)任的立法構(gòu)建提出幾點(diǎn)建議。 全文雖有四萬余言,但由于內(nèi)容龐雜,資料欠缺及筆者水平有限,倍感空洞和淺顯,這有待于各位學(xué)者仁人的批評指正以及筆者自身今后的進(jìn)一步努力。
[Abstract]:Restrictive damage compensation liability refers to the civil liability for damages in accordance with the law, the money compensation responsibility for damages only undertaken within a certain amount.
The limit of liability of damages is both an old and new topic. The reason is that the old said, as early as one thousand years ago, it has intruded into our lives; the new reason is that, in the past one thousand years, it is not in every hour and moment to update and expand, and the different do the unity of research is relatively small, this angle is new. This is the content of this article in the introduction of some of the background.
The first chapter is the introduction to restrictive liability for damages. This chapter describes the concept of limited liability by the damage characteristics and compared with similar concepts to define what is the research object of this paper is discussed, in order to build the research platform for this paper.
The second chapter is on the liability status of restrictive damage. In this part, the first chapter as the foundation, with the search for the historical development of the different types of limitation of liability for damages. From the limitation of liability for maritime claims in maritime law, the limitation of liability for oil pollution damage, the limitation of liability, liability limitation of port operator to aviation, maritime law damage outside the limits of liability, limitation of liability for damage to the railway transportation, the limitation of liability of postal transportation damage, the limitation of liability for nuclear damage, limitation of liability for state damage. These restrictive liability for damages on the upgrade and show its perplexing development path.
The third chapter is the limitation of liability for damage ontology. This part is based on the second chapter, with abstract generalization of general rules of limitation of liability for damage. Including these general rules: restrictive damage compensation liability, property, classification and restriction method. It is also one of the research achievements.
The fourth chapter is on the function of liability value restriction damage. This part of the description for limited liability for damages exist, is of great social function and value. At the same time, the compensation system is not a panacea limited damage, it also has many defects, so the key is how to overcome the defects of the system to play and make up function.
In the conclusion part, the author makes a brief summary of this thesis, and puts forward some suggestions on China's future restrictive compensation responsibility legislation construction.
This paper has more than forty thousand words, but because the content is complex, the lack of data and the limited level of the author, feel empty and shallow, the scholars of benevolence criticism and author's further efforts in the future.
