【摘要】:海事賠償責(zé)任限制制度是一項(xiàng)非常重要的海事法律制度,它對(duì)促進(jìn)運(yùn)輸業(yè)的發(fā)展具有重要的作用。它是海商法特有的一項(xiàng)法律制度,最初僅僅是為了保護(hù)船舶所有人的利益而產(chǎn)生,但由于責(zé)任人的不斷多樣化,漸漸地船舶經(jīng)營(yíng)人、承租人、救助人等也被納入了受保護(hù)的范圍。這一制度的存在對(duì)各國(guó)海運(yùn)業(yè)及國(guó)際海上運(yùn)輸?shù)姆€(wěn)步發(fā)展起到了一定的積極作用。經(jīng)過多年的發(fā)展與完善,這項(xiàng)制度已經(jīng)日臻成熟。 但由于各國(guó)立法不同,且各國(guó)海事國(guó)際私法規(guī)范并不統(tǒng)一,導(dǎo)致了具體案件發(fā)生時(shí),法官不得不面對(duì)著法律適用的問題。因此,在涉外海事賠償責(zé)任限制法律關(guān)系中就需要進(jìn)行法律選擇,以確定所應(yīng)適用的法律。國(guó)際社會(huì)關(guān)于海事賠償責(zé)任限制的法律適用主要有適用法院地法、適用侵權(quán)行為地法、適用船旗國(guó)法、適用最密切聯(lián)系原則幾種立法模式。針對(duì)上述問題,本文意圖對(duì)海事賠償責(zé)任限制的法律適用問題進(jìn)行立法和司法層面的比較研究,以期對(duì)我國(guó)相關(guān)立法和司法提出建議。 本文旨在對(duì)海事賠償責(zé)任限制這一獨(dú)特的法律制度進(jìn)行較為深入的研究,以引起學(xué)術(shù)界對(duì)這個(gè)課題的重視,為海事審判實(shí)務(wù)提供理論參考。本文將分為三個(gè)論述重點(diǎn),第一是對(duì)國(guó)際公約及各國(guó)立法相關(guān)規(guī)定進(jìn)行梳理、分析法律沖突主要表現(xiàn);第二是對(duì)著重論述海事賠償責(zé)任限制法律沖突的解決方法,引入了學(xué)界兩種學(xué)說單一論和分割論;第三是對(duì)國(guó)內(nèi)外相關(guān)完善建議的歸納總結(jié),文章最后得出結(jié)論。筆者認(rèn)為,在海事賠償責(zé)任限制法律適用問題上,“分割制”更能體現(xiàn)司法的公平,增加法律適用的確定性,更有利于海運(yùn)事業(yè)的發(fā)展,同時(shí)也順應(yīng)了國(guó)際潮流。因此提出建議,我國(guó)法律應(yīng)把海事賠償責(zé)任限制中的諸多法律問題分割,按其性質(zhì)分別適用與其有最密切聯(lián)系的國(guó)家的法律。
[Abstract]:The limitation system of maritime claim liability is a very important maritime legal system, which plays an important role in promoting the development of transportation industry.It is a unique legal system of maritime law, originally only to protect the interests of ship owners, but due to the continuous diversification of the responsible persons, gradually ship operators, charterers,Rescuers and others are also included in the scope of protection.The existence of this system has played a positive role in the steady development of shipping industry and international maritime transport.After years of development and improvement, this system has become more and more mature.However, due to the different legislations of different countries and the fact that the norms of maritime private international law are not uniform, the judges have to face the problem of the application of the law when the specific cases occur.Therefore, in the legal relationship of limitation of liability for maritime claims concerning foreign affairs, it is necessary to make a choice of law in order to determine the applicable law.The application of international law on limitation of liability for maritime claims mainly includes the application of the law of forum, the law of tort, the law of flag country, and the principle of closest connection.In view of the above problems, this paper intends to make a comparative study on the legal application of the limitation of liability for maritime claims at the legislative and judicial levels, with a view to putting forward some suggestions on the relevant legislation and judicature in China.The purpose of this paper is to make a deep study of the unique legal system of limitation of liability for maritime claims in order to arouse the academic attention to this subject and to provide a theoretical reference for the practice of maritime trial.This article will be divided into three emphases: the first is to sort out the international conventions and the relevant provisions of national legislation, to analyze the main manifestations of the conflict of laws, and the second is to focus on the solution of the conflict of law, which focuses on the limitation of liability for maritime claims.This paper introduces two theories of monism and division. The third part summarizes the relevant suggestions at home and abroad, and finally draws a conclusion.The author believes that, on the issue of the legal application of limitation of liability for maritime claims, the "division system" can better reflect the fairness of the administration of justice, increase the certainty of the application of the law, be more conducive to the development of the maritime transportation industry, and conform to the international trend at the same time.Therefore, it is suggested that the law of our country should separate many legal issues in the limitation of liability for maritime claims and apply the laws of the countries with the closest connection according to their nature.
