【摘要】： 本文從融資租賃的定義和種類入手，通過與光船租賃、一般融資租賃相比較，顯示船舶融資租賃交易獨特的法律性質(zhì)、法律特征。在我國現(xiàn)有法律體系下，分析船舶融資租賃的法律適用，指出我國目前船舶融資法律方面的空白和不足。主要在《合同法》第十四章和比照適用《海商法》，中光船租賃合同相關(guān)條款的法律框架下，具體研究船舶融資租賃合同的訂立、效力、主要內(nèi)容、雙方當事人權(quán)利義務(wù)、對第三者的責(zé)任等，從而擬訂出一種可操作性強的船舶融資租賃格式合同。本文也對船舶融資租賃的風(fēng)險保障機制和登記制度進行了初步探討，提出若干法律建議。
[Abstract]:This paper begins with the definition and types of financial lease, and shows the unique legal nature and legal characteristics of ship financing lease transaction by comparing it with bareboat lease and general financial lease.Under the existing legal system of our country, this paper analyzes the legal application of ship financing lease, and points out the gaps and deficiencies in the legal aspects of ship financing in our country at present.Mainly under the legal framework of Chapter 14 of the contract Law and the application of the Maritime Law by comparison with the relevant provisions of the Zhongguang ship charter contract, the conclusion, validity, main content, rights and obligations of the parties concerned are studied in detail.The third party liability, so as to draw up a strong maneuverability of ship financing leasing format contract.This paper also discusses the risk protection mechanism and registration system of ship financing lease, and puts forward some legal suggestions.
