【摘要】： 本文以海上保險合同的保險利益原則及其相關(guān)問題為主線，以我國現(xiàn)行的保險法和海商法為依據(jù)，聯(lián)系國外立法，特別是英國1906年《海上保險法》，及有關(guān)海上保險利益的理論，結(jié)合國內(nèi)外保險實務(wù)及司法實踐，，對我國海上保險中保險利益的確定和適用上存在的相關(guān)問題進行了研究和分析，論述了海上保險利益歸屬的主體、海上保險利益的效力維持時間，并分別就海上貨物保險利益、船舶保險利益和海上再保險保險利益進行了闡述。在此基礎(chǔ)上，針對《中華人民共和國海商法》關(guān)于海上保險合同章節(jié)的修改，以及我國保險實務(wù)中應(yīng)當(dāng)引起注意的問題提出了建議
[Abstract]:This paper takes the principle of insurance interests of marine insurance contract and its related problems as the main line, based on the current insurance law and maritime law of our country, and links with the foreign legislation, especially the 1906 Marine Insurance Law of England, and the theory of marine insurance interests.Combined with domestic and foreign insurance practice and judicial practice, this paper studies and analyzes the problems existing in the determination and application of insurance interests in China's marine insurance, and discusses the main body of the ownership of marine insurance interests.The validity of marine insurance is maintained, and the interests of marine cargo insurance, ship insurance and marine reinsurance are expounded respectively.On this basis, this paper puts forward some suggestions on the revision of the chapter on marine insurance contracts in Maritime Law of the people's Republic of China and the problems that should be paid attention to in the practice of insurance in China.
